  • Barclays PPI decision HELP

    Good evening all,

I am looking for some assistance please. After my last experience with yourselves though this is by far the best place to get it.

I have recently been made aware PPI was part of my Credit Card I took out with Barclays in 2008. Now I have been made aware my complaint has been rejected on the basis that back in 2008 I have "ticked" a box and said I wanted PPI.

i have just came off the telephone with them and tried to have a conversation and make them aware that legitimately I had no clue I had PPI, it is unfortunate that my reason of complaint regardless of how true it is happens to be the same as most others too.

however I tried to make them aware as part of the online sale of the card I do not recollect at any point ticking this box etc and would like to see evidence of this which I was immediately hit with yes that's fine £10 please for the pleasure of a DSAR.

However am I right or wrong here that as part of a sale a bank or organisation cannot just presume a customer fully understands the policy and all it includes or even what PPI was (January 2008 I would have been 19, not a clue what PPI was) etc so they must provide written clarification of the policy and a policy document etc, making sure the customer is aware and understand the policy but also offering them a cooling off period? (Which I would have taken advantage of and cancelled as soon as I was made aware of any such policy).

I have never received any info, I was kindly told that the policy which was in my name (cancelled when I became of the policy a few weeks back) was intact an in house policy supplied and underwritten by Barclays themselves for ASU critical illness and life cover. None of this I needs as I have through my employer of whom I have worked since I was 16 on a full time permanent contract.

i would like to know if anyone feels I have an argument as I feel that I should have been provided info on the policy etc it even doesn't show on the credit card statements I receive.

unfortunately I fell behind on my payments and this doesn't help matters that the amount that I fell behind by each month was being increased due to a payment for something which I did not want or need not have any knowledge of its existence. Is this not also in the realms of consequential loss?

any help and assistance would be greatly appreciated.

thanks again for reading over my post

    Cheers Dan

Hi and welcome, if you are convinced the PPI was mis sold then do not give up on this. Complain again to Barclays and when you get a final decision from them then you can go to the FOS with your claim although this does take a while.

Good luck, you will need it with Barclays.
        Did you do a CCA?

Enaid - I wont give up, i was not aware of the policy so believe it is only fair that i am refunded the premiums paid etc, however what i am now more annoyed abotu is that they are trying to reject the claim on the basis that i ticked a box at the application stage. I am sure that i should regardless ben provided all the inf of the policy etc along with the cooling off period because if i was offered this then the policy would have been cancelled within the cooling off period.

They have said i can be sent the details etc but i need to pay £10 for a DSAR to be given this info.

Dogtired - CCA? Again i wont give up and as above i may need to proceed with speaking with FOS however regardless i do feek that there has been a mis jusrice done and i would like to be put back to the position i would have been prior to the policy being taken and premiums paid etc.

          Thanks for the replies guys.

It similar to a SDAR, you pay £1.00 and they should send you basic information, copy of application form and terms and condtions.
I think there are some issues with agrements prior to about 2005.
I am almost at the end of my thether with them after four years finialyy thought I had sorted it and I would be rid of them but not so, they have sent me a chque, very nice but when I got my statement it is now more than it was before all this.
Yu are not alone here we all try and help as we can, my knowledge s a bit limited but have had lots of help and support. xx

I May look inot this option also when they come back to me once they have had tie to look over my case again. I think it is a joke how they can say well you understood the policy if you ticked this box.

This still does not detract away from the fact that i was not made aware of all the terms and conditions, what the policy was, what it covered, what the premiums were, also not given the choice to cancel the policy (cooling off period). I will be honest i really do not recollect ticking the PPI box however if i had done, i would have cancelled it once being made aware of the policy and being told i could cancel it.

Surely they can see that someone does not know of a policies existence when certain questions are asked.
