          Re: Red Hawk Legal

Another email from Red Hawk Legal today at 11am

          Hi Robert

Thank you for your email I refer to your recent communication with regard to the fees of which we are seeking payment .We have corresponded this information to you via telephone and email.
The rights in your contract previously held by Client Connection Limited trading as Lifestyle Claims were sold to us by Sharma and Co who are the administrators of Client Connection Limited. This transaction took place under the provisions of the Insolvency Act 1986. The fees which we are seeking from you are those which were due under the contract you held with Client Connection Limited, a copy has been sent out for your reference, and to which we are now entitled by virtue of the aforementioned purchase from Sharma and Co.

Red hawk Legal acquired the rights in the contracts which Client Connection Limited formerly held with its clients. We did not acquire the debt or the liabilities arising from those contracts. The effect of this is that any claim for damages or other remedy from a defect in performance by Client Connection Limited should either be made to the administrator or submitted as part of a claim under s.75 of the Consumer Credit Act 1974 where fees were paid by credit card to Client Connection Limited.

We are aware of the various opinions circulated on public bulletin boards concerning the assignment of matters to us but our legal advice is that the assignment remains valid and that we are duly entitled to enforce the rights under those contracts
If payment is not received within the next 7 days we will have no other alternative other than to refer the balance of the account to a debt collection agency. In the event that this is necessary it is likely that further fees will be added to your balance and your credit rating may be affected.
I hope that this clarifies matters

          Kind Regards
          Ben Morgan

              Re: Red Hawk Legal

After us giving you many opportunities to pay the fee It is clear you don’t wish to pay the invoice and are trying your upmost best to avoid it. As of right now your details have been passed over to a debt collection agency they will write to you shortly. You will need to liaise with the debt collector in the future

                Hello EXC

I just wondered if you had made any headway with regard to the MOJ letter/information so that I can now pursue Barclaycard for the up-front fees paid. I'd like to press on with this, but am waiting for your direction.

                Many thanks - Katie

                  Re: Red Hawk Legal

                  Hello again EXC

You posted this to me on 20th November. Sorry to both you - just thought about it today and wondered what I should do next......

                  Hi Katie

Yes sorry but as I think I posted subsequently, I wanted to speak to someone senior at MOJ first.

The issue is that your credit card company (and others we're helping) want proof of breech of contract with regards to the priority service fees. The problem is there are no written contracts in respect of those fees and as such proving that they were refundable would be difficult. So I'm trying to persuade the MOJ to issue a statement to substantiate your (and others) sec 75 claims to the effect that the priority service fees were indeed refundable at the end of the claims process and if no refund was given it was a breech of contract.

So please bear with me on this.

Well done. Barclaycard are a bit hit & miss when it comes to s75 claims.

                          Re: Red Hawk Legal

Katie, typically Lifestyle took an initial up-front fee of £359 per claim during the initial cold call and then they would call again selling the 'priority' or 'fast track' service for a fee of £719 per claim. As the e-mail I sent you shows, there is a distinction between the two in terms of if and when they should have been refunded and it's this distinction we need to define to Barclaycard.

I know you paid the priority service fees but did you also pay the initial £359 fees?

Also do you have the original Lifestyle terms and conditions? If not I have them.

got my first phone call from universal debt collections today, friendly girl on the phone said that my name had been passed to them via Red Hawk legal, asked for payment , i told her that i wasnt going to pay and she asked me why i told her that i didnt have a contract with Red hawk legal and had never heard of them untill my PPI claim had been paid out, told her that my contract had been with Life style claims and once they went in to administration my claim had been cancelled, i told her that i had a letter from the administrator and i was a creditor of Life Style claims and as such Red Hawk legal had no claim to any fees , also said Sharm didnt have the rights to sell my claim as they didnt have an MOJ licence she told me she would contact me again once she had spoken to Red Hawk scammers, will let you know what happens

Fantastic response Flakey, let's see what Redhawk try to do next.

I suspect Universal will carry on and send out the usual threatograms either by post or phone.
