    Yes sorry but as I think I posted subsequently, I wanted to speak to someone senior at MOJ first.

    The issue is that your credit card company (and others we're helping) want proof of breech of contract with regards to the priority service fees. The problem is there are no written contracts in respect of those fees and as such proving that they were refundable would be difficult. So I'm trying to persuade the MOJ to issue a statement to substantiate your (and others) sec 75 claims to the effect that the priority service fees were indeed refundable at the end of the claims process and if no refund was given it was a breech of contract.

    So please bear with me on this.

      That's fine EXC - you told me that it would take some time and to bear with you - I'm quite happy to do that. I was just puzzled when the idea of chasing RHL for the up-front monies came into the conversation - but now I know that I am not going to do anything with that, then I'll just wait from some direction from you. Hopefully you seem to know someone at the MOJ who can help out - so let's hope that they can and that it will end up helping lots of us (not just me!!!)

        Sorry I'm confusing us both!

        By all means complain to Redhawk now. The statement I'm hoping to get from MOJ is for your section 75 claim to your credit card.

The only way is a claim under s75 and this is what you need to focus on as LSC went into administration and failed to return money due to due for claims which there was nothing to claim for.

          The TS at the MOJ confirmed to me that if they were unable to make a claim on the behalf of a client within 8 months a full refund from LSC should have been repaid and certainly a claim under s75 should have been executed. Your best bet IMHO is that you should continue to claim this money back from your bank/credit card provider.

          that's why I feel I shouldn't pursue RHL as it would be pointless - but following up S75 is definitely the way to go!!

              Received another letter today from Red Hawk Legal from their operation manager" Martin Boland"

              "Thank you for your recent letter regarding our authority to act in this matter"

              Red Hawk Legal acquired the rights in the contracts which Client Connections Limited formerly held with its clients.We did not acquire the debt or the liabilities arising from those contracts.The effect of this is that any claim for damages or other remedy from a defect in performance by Client connection Limited should either be made to the administrator or submitted as part of a claim under s.75 of the consumer Credit act 1974 where fees were paid by credit card to Client Connections Limited.

              We are aware of the various opinions circulated on public bulletin boards concerning the assignment of matters to us but our legal advice is that assignment remains valid and that we are duly entitled to enforce the rights under those contracts.
              I hope that clarifies the matter but please contact me should you have any further questions

                Yes they're sending out these letters to a few of our members.

                They seem to think that they can lawfully acquire the elements of people's contracts that are favourable to them but ignore the bits that aren't.

                Can you forward this to consumer@claimsregulation.gov.uk please?

                        Hi Robert

                        Ultimate law sent a chq for the sum of £750 on the 19th of November we would like to ask you one last time to pay the
                        30%+vat fee totaling to £270.00.

                            Hi i contacted the MOJ, spoke to Carl Latham, he just asked me to send everything i have on Red Hawk legal, letters i have sent and my original contract with Life Style, he said they have no power to stop Red Hawk legal chasing fees from me they can only build up a case and try and stop them breeching the code of practise, he suggested i get legal advice

                              Ok. Of course it's pointless taking legal advice yourself unless Redhawk take legal action, which looks very unlikely given that they've failed to with anyone else.
