  • First Direct refusing PPI

I applied for a personal loan with First Direct in 1993 together with my then wife and I applied for another loan in 2001 in my own name. For both occasions I have a copy of the original applications which show that PPI was taken out on both loans. Both accounts were closed in 2004 when I went into financial difficulties.

Last month I filled out an FOC Questionnaire and asked First Direct for the PPI to be repaid. I received a letter this month saying "Our records show you applied for the loan on 21 March 2001. Under the terms of the Data Protection Act 1998 we're obliged to keep transactional data for a maximum of six years, so although we have a copy of your original application, we do not have any transactional data. We are therefore unable to progress your request any further at this stage. However, if you can provide us with documentation confirming the premiums you paid, please forward this to us and we'll look into it for you."

I subsequently paid £10.00 for a SAR and was sent a whole bundle including copies of the original applications, but I don't know where to find any details of PPI transactions.

    1. How do I find documentations confirming the premiums I paid?
    2. In 1993 the loan was taken out jointly with my then wife. As I am now divorced, can I still claim for PPI on my own behalf?

Any help would be greatly appreciated.

    Re: First Direct refusing PPI

    Hi and welcome
I note you said that you have copies of the original applications, does it actually show the amount of PPI of what they said you were to pay?
Its usually calculated within the loan, so they should work out the approx amount of the actual loan repayment where the remaining of it would have been PPI.

If your not sure of what the full loan repayment you were paying back each month, maybe your bank you banked with may still hold the details on copies on statements, therefore it maybe worth you calling into the local branch by giving them your bank account number in order to track down the information on your statements.

May I ask of what details you did receive of the SAR?
Are there any details at all of the insurance?

In regards of the loan being in joint names, even if it was a single cover for one, it still involves both partners.
If your still on speaking terms, maybe you could have a word and ask if you minded making a reclaim (even though your ex may want half) but I think the bank will require 2 signatures.
Unless someone can say otherwise, but that's as far as my knowledge of this.

      Well done Di

      Yes--the application is key--look for:

      Amount of Loan
Amount of extra PPI single premium loan
      Total of both loans

As above--but the actual mthly premiums

Also look for total months of the loan too

We'll help you further when we have info as above
