  • RBS, Are they being fair

    Hi,

I have just had a PPI claim rejected and I need advice. My main problem has been I cannot be clear how I applied for the card, I believe I was canvassed by a sales person in a shopping centre but I cannot be certain as it was in 1997. I do remember making a call and being advised I should have the insurance.

I was called by RBS during the investigation and I was honest and shared the above information as I felt to lie would be wrong.

I have now had a letter stating they cannot uphold my claim, in the letter it says that I said I was unable to remember anything about sale (untrue i said couldn't remember clearly), that I didn't apply for it in a branch (that much is true). Finally, as I ticked the PPI box and signed the form I acknowledged and consented to the details provided.

My complaint is that the PPI was sold to me despite it not being required, I have worked for the same company for the whole period having the card, I have a very good sickness and redundancy package and would realistically have never needed to use the PPI as I would have always have been able to cover the balance.

Do I have a case to challenge their decision?

On the basis you said above, ie that you're recollection is that you were told you had to have the PPI with the card and that no one asked about your existing benefits which were effectively doubled. I think this case might be an FOS one if they have given you a final decision.

As far as I know you have every right to appeal, my husband did the very same with a Lloyds credit card (started 1991), Lloyds threw it out, we appealed, they said sod off again, so we went to the Financial Ombudsman late last year, we got a letter yesterday saying that they have upheld our claim, they have written to Lloyds to either give us an offer or appeal again by the 29th March, I've been told today by someone on here that they will most likely make the offer.
      It worth appealing.

Have used it for almost 7 years(many with my alter ego natweststaffmember) and furthermore I studied Wilfred Owen in school. A very much underrated first World War I Poet who died barely a month before the end of the war. At the time of my alter ego's emergence on the forums it was very very appropriate...

"Anthem for Doomed Youth". "What passing bells for those who died as cattle" - apparently his first draft was "What passing bells for those who died so young" - the change shows why he's a genius doesn't it?
