    Hi all

    I received numerous phone calls from Lifestyle Claims saying that there was a claim to be made. A sales person was telling me about how he could help to recover any PPI claims and/or bank charges which I may have. Long story short I agreed to it not realising that they were going to charge me before even I got their pack. I never received their "legal pack" but few weeks later I got letter from my bank saying that there was a payment made for around £700 from my credit card. Then I contacted Lifestyle Claims trying to cancel all this but they have asked me why I didn’t do it within 14 days my cooling off period. So I told them I never received anything from them and they didn’t receive anything from me and I didn’t know they were going to go through with it until I saw my bank statement. I understood this as they were gonna charge my after they will get their pack back with all my details not before. They told me to contact customer services which tried selling me other stuff not listening to what I was saying. Finally I sent an email to people that deal with complains. A week later which was on the 12th July I got a letter from them saying that they are going to deal with it in next 4 weeks. Is there anything else I can do? I spoke to people from my bank asking them to freeze my payments but they have said that me and a company have 60 (90?) days to solve this problem and they can’t do anything about this until then.

    Hi Rzonka

    Have a read here http://www.justice.gov.uk/downloads/...lletin-13.pdf/ this is from the Ministry of Justice the very people that authorise Lifestyle claims. If you read this directive Lifestyle Claims have broken the rules so suggest that you point out the specific rules to them from this directive and advise them that if the money is not returned immediately you will not only bring this to the attention of the MOJ, the police and trading standards you will also take this matter to the press.

    If you have any problems whatsoever in getting your money refunded we will do our best to help you. I can advise that we here at Legal Beagles have a meeting with the MOJ set up in August and would be happy to bring your complaint directly to the table during our meeting as having actual complaints like this will show the MOJ how the CMC's are still flouting the rules. You should have been given the T&C's to read and understand before any money was taken from your account.
    They should have sent you the pack which has to be returned within 14 days if you do not wish to take up the offer? since none of this happened they actually have taken money from your account without your express permission and therefore you should go back to your credit card provider and advise them this that you never gave them permission to take this money from your account.

    What actually did they tell you that they could claim for you if it is PPI, do you know if you have ever taken PPI? as again the MOJ are quite clear on this that too many claims are being sent in without foundation of PPI ever having been taken.

    You have to know that Lifestyle or any other CMC company are not privvy to any of your personal information and cannot possibgly know if you have or have not ever taken PPI so therefore if they sold you this on the basis that you have money to come back they are again breaking more rules.

      Just to be clear the bulletin from the Ministry of Justice no15 http://www.justice.gov.uk/downloads/...n-jun-2012.pdf states about claiming PPI and unless you know for sure that you were definately mis-sold PPI and that you actually have PPI before making any claims.

              A few weeks is NOT good enough. Demand that you speak to one of the directors and advise them that you have the MOJ directive bulletin no 13 and 15 in front of you and they have not adhered to the MOJ rules. Tell them that you must have that money returned immediately as it is not in their interest to to have trading standards, the police and the press involved as well as the MOJ breathing down their necks as well as your credit card povivider will be also be advised that they took the money without your express permission. The choice is theirs buut I would not give them 2 weeks, they did niot give you the opportunity to agree with the their t & C or to be able to return the pack within 14 days due to them not sending it out to you in a timely manner in order for you to do thsi. I would not take NO for an answer.

              You have the law on your side and would suggest that you fully explain to them that you will if you do not get the return of your money by CREDIT CARD in next 48 hours then you will follow out your threats and go to all the authorities I have told you to do so. As long as what you have told me is correct in as much as and that they did not give you time to check the t&C's before they took your money,

              By the way at which point did you give them your credit card details?

                Sorry but I had no internet access. I have given them my card details when I spoke to them the first time. There was no communication between us until I got my credit card statement almost a month after. So I started ringing them and after few calls later I got my pack which was outside my cooling off period.
                Regarding my complain I got a letter from them with their decision saying that they won’t give me my money back because on the day of first contact they have sent my T&C via email which I have checked in my pack is wrong. So not only I didn’t get my pack on time but email address they have is wrong.

                  Have you phoned your bank/credit card company and told them they took the money unlawfully from you without your express permission?

                  You did not agree to this service and they took your money from your card without you ever had seen and agreed to the T&C's.

                  As the pack came after the cooling off period and they gave you the wrong email address and you were unaware that they had even charged your card until you got your statement they are refusing to refund you and now you have received a letter from them refusing to repay your money back. Therefore you were unable to cancel this and you want your credit card provider to obtain that refund back for you.

                  Also, have you made a complaint to the Ministry of Justice yet regarding this as they have broken several guidlines laid down by them in your account of what has happened. If you have not done so you must do this immediately.

                  Our forthcoming meeting is in next few week at the MOJ, so if you also PM me your details of your case urgently in chronological order and you could also use this format for your complaint to the MOJ as well with this information.
                  The date they first called you
                  How many calls did they make to you before you gave them your credit card details?
                  Did they send you or allow you time to read those all important T&C's before they took your card details?
                  Did You agree to how much money they were going to take from you?
                  How much did they charge your card by and on what date?
                  What date did the pack arrive after your last/or first call with them?
                  What date did you discover when you received your bank credit card statement that they had charged your card?
                  What action did you take when you found out?
                  What date did you complain to Lifestyle Claims and methods?
                  What method did you use to contact them, ie phone, email etc... and dates?
                  What date did they they respond?
                  Do you have a reference number at Lifestyle Claims?
                  Your name and address and email address please as well.

                  All this is very important to get down in some logical order enough for you to make a serious complaint to the MOJ and also to give me all the details by PM, so that we can send this to our contact urgently before next meeting in just under a couple of weeks so that they have a chance to look into this for you and we can discuss this with them at our meeting with top management and bring this to the their attention regarding Lifestyle Claims who are not following proper guidelines laid down by them under their authorisation with the MOJ. If we have details of an actual case like yours it is easier to demonstrate to them how the general public are being treated and they need to know at top level what is going on here.

                    Just to add to what Tuttsi has said it would be really helpful for us to show the MOJ your letter from Lifestyle that they won't refund you on the basis that they e-mailed you the T&Cs on the first day of contact - as this clearly breaches the rules on several fronts.

                    Idealy we'd like a copy of the letter in full inculding your name & address etc (in order that they can investigate it on your behalf) but we appreciate that if you're uncomfortable with that, you can blank it out.

                      Hi there. I have agreed that Lifestyle can look into my history to see if I am due any PPI compensation and filled in their pack. Now they are demanding £300 upfront to recover £3,000. Do I have to pay this money to them or can I still back out? HELP PLEASE!

                          Hi folks I'm new to the forum. Need some help as I too have stupidly given my credit card details to Lifestyle Money after a cold call too. Now they have 2000 pounds of my money after taking 398 pounds times two =798 pounds (apologies for no pound sign!) for a 'refundable deposit' and another 598 pounds times two to create an account (one for credit card PPI and one for Loan PPIs). I didn't receive a letter after the first phone call and only found out they had taken the 798 monies after I checked my online banking after a few days. They reassured me it was a refundable deposit and kept reiterating that they are regulated by the Financial Ombudsman and that I would not be left in a worse financial position than before their conversations and that if I was unsuccessful I would be fully refunded of all the money I had given them.

                          Now after being on here I am seriously worried about the money they have taken as a 'deposit'. It has been three months and on the last phone call to them today they said they are should have notification by now from my credit card companies. I'm frightened they are fobbing me off and I'm really scared they will keep me waiting like the other man who had to wait 8 months only to be told he was unsuccessful. I had no idea they were such an awful, unscrupulous, despicable company who take your money unlawfully.

                          Please help any advice would be greatly appreciated!!!!

                            Ok please give me chapter and verse
                            ie Date when they first called?
                            Date and how much money did they take?
                            Did they give you an opertunity to read their T&C's before they took your credit card details?
                            Were you aware of the amount they were going to charge your card?
                            What date did they come back and ask for more money?
                            Did you agree to this?
                            Do you actually know if you have PPI?

                            As much information in chronological order will help us to help you.

                            Do you have a reference number with Lifestyle - PM me is you so wish.

                            If you can give me as much information as possible I will take this further with the MOJ personally for you.

                              Hi Tuttsi, thanks for replying to my post.

                              They first called me on 17/5/12

                              money taken from cc account 17/5/12

                              amount taken 398.98x2 719.96

                              no i wasn't given opportunity as the money was taken the same day as the first call was made.

                              I wasn't fully aware that they would take the money straight away or I wouldn't agreed to it (stupid I know)

                              I contacted them a week later after viewing my cc statement, to say that that i was not aware that they were going to take the money. They then read me

                              back a transcript where it made me sound like i had a agreed to it. All the while they kept reassuring me that I wouldnt end up any worse financially.

                              I even asked them if they were trying to scam me, to which they replied that they were regulated by the Financial Onbudsman and the Ministry of Justice and that I wouldn't be in a worse financial position than before our conversations.

                              I then filled in some forms in the PPI reclaim pack within a week of sending these in, they contacted me claiming that I had 2000 pounds owing on 2 cards and that they would need 598 x 2 (1196 in total) to set up an 'account' for each claim, I agreed to this on the basis that they kept reiterating that it was all refundable etc (I know...)

                              This money was taken on the 30/5/12

                              Up until this point i was not sure if i had any PPI or not.

                              My Partner was unaware of the details of this until today, and was immediately suspicious when i explained the money that they had taken, he did some research on the internet and discovered that the company seemed less than reputable. He rang them trying to get answers, and asked where all the confirmation in writing was- after a terse conversation he was assured that we would receive all the confirmation in writing, but he immediately smelled a rat and here we are trying to see what our options are in terms of getting out of this situation with our money back.

                              I will PM you my ref no- but please bear with me as I am new to the forum and still finding my way about.

                              Thank you again in advance for any advice/help you can give.
