    Hi there,
    I was wondering if anyone can give me any advice on an issue with Alliance & Leicester PPI.
    I have been helping my mother with her claim for a credit card from 1993-2006. We contacted Santander (who now own Alliance & Leicester) who said to speak to MBNA as they own the credit card side of the company. I did so and spoke to the guy who agreed it appeared that the ppi was mis-sold, and they would investigate the claim and get back to us. We had a letter through 2 weeks later from MBNA to say that when they took over A&L my mother was given the option to cancel her ppi, but as a good will gesture they would pay back the ppi from the date they took over, and the next day a cheque arrived for £600 (based on a card limit of £1000).
    It also said in the letter that while they will pay from the transfer date, they are not responsible for the previous period before transfer, and as such will pass on the claim to the previous lender who should contact us in due course.
    This is where we are left confused. I believe that if a banking company takes over an asset they are liable for any previous dealings the company may have had. As A&L are now owned by Santander I can only assume this is who they will have passed the details to. I also assume Santander will say they are not responsible which leaves us wondering wether to cash the £600 cheque or not.
    Looking into it, MBNA took over in 2003, which I think makes sense for the amount they've paid. Which would mean there is 10 years worth of PPI my mother would have paid.
    Has anyone had a similar experience?
    Sorry to waffle but thought I'd put as much detail in, it might be worth pointing out that my mother has no paper work from 2003 previous (statements, account dealings), we know the exact year the card started (1993) from our conversation with MBNA.
    Also one last thing we noticed was that for some unknown reason, accidental death cover appears on statements from late 2003 to 2005, at £8 a month. I mentioned this to the guy from MBNA who said 'oh, yes, that is strange, I think you will be owed quite a big one". We've heard nothing more on that note.
    Thank you for taking the time to read this, any advice would be massively appriciated. I know £600 a lot of money, but if my mother is owed more We want to make sure!!

    I assumed they would have also taken over the liabilities, but see what comes back from the previous lender and take it from there, if you can let us know that would be cool.

    I would however still contact the previous lender to make sure all is being dealt with, write to them and state that you understand that Santander have forwarded details in regards of the years up until the transfer and you will appreciate having some sort of acknowledgement from them to confirm on this. How long ago was it that Santander said they passed on the details?
    If over 2 weeks ago, then definately chase them up, if not do give them that stated timescale before you do.

    In regards of the other insurance, also put it into writing that this was discussed with them (if you can recall the date) give them that to and up to now you've heard nothing at all.

      I know your post was a few months ago but just found it while researching A & L/MBNA. I am in exactly the same position as your mother - the letter I received from MBNA seems to be identical to the one received by you. They have refunded PPI from 2003 and yesterday I sent an email to Santander ("the previous lender") to chase up PPI before 2003. Today I received a letter saying that they have no record of any PPI paid by me. Have you heard back from Santander? Does anyone know where I should send request for SAR because I know I was paying PPI before it was taken over by MBNA and that was confirmed by them. Would be grateful for any feedback.

        Hello Ellen,
        I am in the same situation. I need to ask A&L for my SAR to trace my records dating back from 2003 but I do no know where to write.
        Did your post receive a private reply with the information you were seeking ?
        If so would you mind sharing it with me ?

          Hello everyone!
          Yes, it sounds identical to my situation
          MBNA refund everything from the period they had A&L card and referred the the portion of my claim to our favourite Santander , well known for not liking to part with funds they owe to us
          Santander then wrote to me saying they would refund as soon as I provide them with any credit card statement from 2001 as they need to see the balance to refund They were even given my PPI number (policy number), which I luckily had.
          Of course I did not have a credit card statement from such a long time ago.
          So Santander "regretfully" were not able to refund
          However being registered with Experian credit reports I regularly got statements with all the balances, so I called Santander to inform them that we had a solution and I'll be sending them the copy from Experian report with requested balances information. After initial shock and disappointment they put me on hold to talk to their supervisor who advised that Experian reports cannot be accepted.
          That was my first encounter with Santander and then I did not know yet that they had no intention to repay anything, but every intention to find any way not to do it.
          Then I had no experience yet to fight with them, so I contacted the Ombudsman, honestly thinking that they, Santander, may be right and without credit card statements I cannot get a refund. The Ombudsman representative was very good and he insisted that I complain to them, furthermore he wanted to do it straight away over the phone to make sure I do it and he wanted to help me with the form.
          That is the only case I have with the FOS. The Ombudsman representative indicated straight away that based on their previous cases Santander were wrong
          My case, of course, will take a long time.

          So, once you were repaid by MBNA, Santander will not argue that your PPI was mis-sold and would agree to repay. Having SAR will be very helpful. I hope you'll have all the necessary information.
