I was wondering if anyone can give me any advice on an issue with Alliance & Leicester PPI.
I have been helping my mother with her claim for a credit card from 1993-2006. We contacted Santander (who now own Alliance & Leicester) who said to speak to MBNA as they own the credit card side of the company. I did so and spoke to the guy who agreed it appeared that the ppi was mis-sold, and they would investigate the claim and get back to us. We had a letter through 2 weeks later from MBNA to say that when they took over A&L my mother was given the option to cancel her ppi, but as a good will gesture they would pay back the ppi from the date they took over, and the next day a cheque arrived for £600 (based on a card limit of £1000).
It also said in the letter that while they will pay from the transfer date, they are not responsible for the previous period before transfer, and as such will pass on the claim to the previous lender who should contact us in due course.
This is where we are left confused. I believe that if a banking company takes over an asset they are liable for any previous dealings the company may have had. As A&L are now owned by Santander I can only assume this is who they will have passed the details to. I also assume Santander will say they are not responsible which leaves us wondering wether to cash the £600 cheque or not.
Looking into it, MBNA took over in 2003, which I think makes sense for the amount they've paid. Which would mean there is 10 years worth of PPI my mother would have paid.
Has anyone had a similar experience?
Sorry to waffle but thought I'd put as much detail in, it might be worth pointing out that my mother has no paper work from 2003 previous (statements, account dealings), we know the exact year the card started (1993) from our conversation with MBNA.
Also one last thing we noticed was that for some unknown reason, accidental death cover appears on statements from late 2003 to 2005, at £8 a month. I mentioned this to the guy from MBNA who said 'oh, yes, that is strange, I think you will be owed quite a big one". We've heard nothing more on that note.
Thank you for taking the time to read this, any advice would be massively appriciated. I know £600 a lot of money, but if my mother is owed more We want to make sure!!
