      I have had 5 of those letters one for each claim. Just waiting for the next ones. Is should be in about 4 weeks now and counting.

        Hi SkintKim - I see Di and other good peeps have been giving you help and encouragement. I assume that you are putting your house on the market because that will buy you some time before BH consider repossession - and NOT because you actually want to sell it ? If that is the case, then I guess you need to price it as high as possible and refuse to haggle - and make it as unattractive as possible to viewers. In effect - do a 'makeunder,' and be imaginative. Instead of the smell of baking bread and/or fresh coffee, go for the aroma of ripe camembert and boiling cabbage. You can probably simulate damp mould with artist's charcoal - etc., etc., etc. Off-topic advice, I know, but I've been in the same position years ago. You need to buy time - NOT sell your belovéd home - focus on that.

        Next thing I reckon is to be ready to deal with the eventual fruits of your PPI claims. Get the groundwork done now, so that you can deal swiftly with whatever BH finally come back to you with. They may make an immediate settlement offer, in which case you need to be ready to deal with that. They may turn the claim down. They may offer on some accounts and not on others.

        Although I can appreciate that you will most likely be inclined to accept whatever you are offered, considering the urgent nature of your circumstances - please do NOT accept any offer until you have been able to evaluate it properly. In particular, please do not sign any 'Full and Final Settlement' without checking in here, first.

        I think we need to be ready for two possible outcomes, with respect to each separate loan - either a refusal or an offer. If a refusal, then we need to be ready to deal with that, and I think it might be worth looking at the different reasons why you consider mis-selling took place here:

        If mis-selling is admitted, then we need to be able to evaluate the refund offer(s). I appreciate that time is of the essence here, so it may well be more important to accept an offer immediately in order to take your home off the market - as opposed to negotiating a higher refund amount. But what we can do meanwhile is try and get some idea of what to expect. If we have that readily available when the offers drop through the letterbox, then we can instantly decide which offers to accept, and which ones to refuse.

        If you would like to try getting this aspect underway, then here is a spreadsheet that we use for fixed-amount loans. It helps you calculate what amount to expect from your PPI claim. Make copies of it for each account you are claiming on. Basically, we need to get the ducks lined up ready.

        Hope I've helped - and NOT overloaded you with too much !!!

                            Hi everyone, I have heard back from black horse and they agreeing on 2 of the six claims were mis sold. Their workings out mean nothing to me and I am not sure how much I will be getting back. I am in arrears so I know this will come off my arrears ( thank god) but when I spoke to them they said the interest will come to me. I am totally unsure of what their sums mean is there anyone out there who may be able to explain? Many thanks

                                Hi Kim, and well done, as Di says. If BH have admitted mis-selling on two of the loans, then this bodes well for the others, and I would expect them to admit mis-selling on those as well.

                                As for evaluating their offer(s), this can take some time and effort, I'm afraid. Firstly, have you managed to take a look at the spreadsheet I attached in my previous post ? If you're not able to use a spreadsheet, then we can still help you, but we will need facts and figures, of course.

                                If you don't have enough data on which to base your own calculations, then that is not the end of the road. Firstly, you are entitled - under FSA/FOS guidelines - to a proper explanation as to how your offer(s) of redress have been calculated. Just a bunch of sub-totals is NOT enough for you to make an informed decision on whether to accept their offer. You are IMO entitled to know ALL the dates and amounts on which BH have based their calculations, BEFORE you can be reasonably expected to make your decision. I would suggest that you write back and request this detail, quoting from the FSA Dispute Resolution Handbook:-
                                DISP APP 3.9.4 The firm should make any offer of redress to the complainant in a fair and balanced way. In particular, the firm should explain clearly to the complainant the basis for the redress offered including how any compensation is calculated and, where relevant, the rescheduling of the loan, and the consequences of accepting the offer of redress.
                                Additionally, you could also send them a Data Subject Access Request (DSAR). This will cost £10, but entitles you to copies of ALL the data they hold on you - the 'Data Subject' - under the Data Protection Act. They are obliged to comply fully within 40 days.
