  • Egg cc ppi & the FOS

    Made a complaint to Egg over ppi added to a credit card, they responded with 'you ticked the box so we wont deal with your complaint' also stated that it was their final response so I took it to the FOS.

    Not long after I filed my complaint, the FOS wrote stating that Egg had ageed to
    Refund PPI & would write to me with details of what would be refunded, also enclosed with the FOS letter was an 'acceptance form' which they stated I had to sign in order for Egg to proceed with the refund.

    Egg did not forward any offer & just sent a cheque & stated it was refund of premiums plus 8% simple interest. I complained to Egg that they were supposed to write with a breakdown of the refund for my consideration & that my complaint still stands and thst I accepted their cheque in part settlement only.

    They refused to deal with my complaint any further & stated that I signed the FOS acceptence form so thats that. Took it back to the FOS and said I wasnt satisfied with Eggs settlement, just received a phone call from the FOS who stated that they will reopen my complaint but I was shocked when they stated that as Egg made the refund it was made as a gesture of 'goodwill' & that if I wanted the FOS to investigate my complaint they would do so but warned me that if they (FOS) found that the PPI was not mis sold I would have to repay Egg all the money paid.

    Incidently ppi complaint was made under ppi box already ticked on the online application & that I was self employed with no fixed contracts.

    Oh Beachy, that's just one of the dangers that lay behind signing an FOS acceptance form...

        Good to hear from you again.

        I think the risk is too high should it go the wrong way - it shouldnt but it COULD

        The interest involved is about £1,500 BUT if it did go the wrong way EGG might want the £3,400 back.

        Barclaycard missold ppi over self employment status, took a long time for the FOS to deal with it, but again had to sign that darn form before they settled HOWEVER BC refund was almost three times what I expected, included all compounded interest on monthly premiums & was back dated to 1991 ( As a result Iam no longer indebted to Barclays in anyway )

          Greetings Beachy,

          How are things bud the dreaded FOS acceptance form is there for one reason only to ensure they get there payment I say this because I had a terrible job getting the FOS to correctly investigate my complaint and in the end as I was getting stressed out over the amount of time they was taking I made my own proposal to the bank with no input from the FOS the bank accepted this but the FOS tried to take the credit and insisted on the acceptance form so they could get there fee on a complaint that they did not resolve.

          The FOS expect you to sign these with no sight of the calcs or method of how they came to such figures and it could be wrong and in many cases it is as banks strongly exercise damage limitation.

          It would seem that any offer is good enough whether right or wrong and thus warrents there form to be signed.

          Never ever sign it until you are happy with what the bank is offering and certainly not before any calcs and method of calc has been supplied.

            Hey hiya Pompey me ol' mate

            Lesson learnt the hard way, cant afford to run the risk of it going wrong - although it'll always leave a bitter taste in the mouth when I think of Egg.

            Rarely log in OTR now to be honest, too much going on in our lives (sooner 2011 finishes the better).

            Wife had an op on her hand just after Chrimbo, then had to have another on the same hand, also lost her Mum end of Jan. to the big C.

            If that wasnt enough OH just had an emergency op on her knee & is recovering well, on top of all this the hospital pre op picked up a potential 'problem' with her heart and that is now under investigation.

            At the end of the day whats money worries when all this is going on.

              surely a consumer can go back to the fos if they aren't happy with the amount of compensation even if they have signed the settlement form? the fos letters state come back to us if you haven't heard from the bank in 4 weeks or if you are unhappy with the settlement. i would 'av thought that had 'owt to do with the principle of an agreement being reached? especially as the figures weren't agreed at the time of the agreement to settle. I have this problem with egg, who have ignored the fos adjudication and I noticed they have just reduced the loan tally by a silly sum so i have clearly got to go back to egg with my own figures (which they'll ignore) and then revert to the fos to argue for more £ based on my own calculations.
