wilchy, try and persuade the court to do that mate.

How would I go about doing this?

I also find it ludicrous that BC is even bothering with this as he knows I can only afford what im already offering for the time being until I get my financial situation sorted when my hours are increased again at work! And the letters he writes are very amateurish. You should have seen the letter that came with the Consent Orders! The figures didnt make sense. LOL. My 4 year old boy could have done better.

Also to all that get worried and depressed in situations like im going through. DONT!!! It really isnt worth it. Sites and people like the ones who are helping me with this are a life saver. Plus when you get into it its a good challenge and a great learning curve. (in a way?)

I don't know as I have no litigation experience but, judging from the above posts, one thought might be to amend the defence and rmove reference to your quantified claim for PPI and to state that the amount disputed is as yet unquantified, is in dispute and the FOS have yet to adjudicate. And also to exhibit the FOS letter you have requested whereby they ask Egg not to litigate while the dispute being investigated. Might just encourage the court to stay proceedings while that gets sorted?

They TRY to take away the will to live mate, let alone our will to carry on working and remedy our past mistakes (like becoming Egg customers). Make that point to the court of course.

The trouble is I cant afford to amend the Defence. I suppose like Amethyst said the Defence isnt too bad. I have put in there that its currently with the FOS so hopefully the Judge will pick this out?

Im Putting my aq in tomorrow morning. Will keep everyone upto date on this and hopefully will continue to get some good help again.

Had a few days off DS.

Wilchy, its an allocation hearing, and you only attend via telephone.

Basically means they havent decided from the statements of case etc whether the case should be small claims/fast track, how long it will need, and what directions are needed to help the case along.

you have to lodge all documents you intend to rely on with the court 24 hours before (and copy to the other party) He's listed what you need in the letter (which is nice of him)

The telephone hearing will be 20 minutes- if unsure of anything just give the court a buzz. The Claimants arrange the telephone conference. (are BC down as claimant on that form ?) and should let you know when it is.

Its just a three way telephone conference really, quite straightforwards and you don't need a tie Just don't butt in while the Judge is talking and try not to sneeze down the phone or it makes everyones ear drums explode. I had one with Abbey and it was soooooooooo much easier than attending in person.

Sorry I didnt get back last night.

Will I be asked alot of questions on the call?

The Claimants name is EGG and not BC, does this mean anything?

So the sort of stuff I need to send in and have with me is:

My draft order I decided to send them to do with PPI doc's and What are copy application, case summary and statements?

And im assuming I am not relying on any other docs as stated in the letter?

sorry for all the q's just havent a clue what it all means.
