      All I did was state that I believed that it was sold as a condition of getting the credit card. I had no documentary proof and they asked for no proof. There is a very good list of PPI mis-selling reasons on the Martin Money Expert website. Use one of those.

        Hi Debt Star, FOS "can" get proof of the actual sale and how it was sold via a Subject Access Request much the same as the consumer can. They actually ask that the bank send over the file of the consumer when they get a complaint in and often within the file is the way in which it was sold. They can even send telephone conversations on a CD so they get the general idea from this.

        You cannot just use one of them without it being truth because there is a way in which the adjudicator can often prove/disprove a statement. Really and truely you have to either state fact or put you cannot remember on the complaint form and it if you lie "once" this could hinder the complaint and it not be upheld.

          Thanks for the additional explanation. In my own case, which I won, I claimed that the PPIwas packaged with the credit card application in a way that led me to think that it was essential. I had no written proof as all paperwork dating back to 1999 was lost by me and also by Abbey. Abbey had no CCA or any other paperwork and so the debt was also written off, as well as the PPI being refunded. So in my case, the FOS did not have anything other than my word and that of the Abbey, but I told the truth as I saw it and did not lie.

          My account also appeared to be too old (over 6 years old, t was taken out in 1999) for the FOS to become involved in, but they did take it up and made the Abbey pay up. With regards to the FOS upholding complaints it was recently reported that over 80% were upheld.

          There is no doubt that mis-selling has been rife within the banking industry and it is only right that customers should seek repayments where appropriate.

            Got your PM--don't matter re your agreements at moment and us doing any sums--you are a long long way from needing our help in analysing a potential offer

            As Marshy says--you've got GENUINALLY list the reasons why you were mis-sold and she will help you from there

            I'm not very good on procedures-stick mainly to Sums and follow-ups after the "offer stage"

              Jaydp, PM me your email address and i will send you scans of my PPI claim letters to Egg. They will need adapting by you because I have three claims on the go! But you should get the gist of it and I'm very happy to help if I can.

              Also, download the FOS PPI claim forms from their website. The forms take you through the kinds of questions you have to answer to make your claim. The forms themsleves need to be sent to the creditor in the first place before FOS involevement anyway.

                Hi Turbo Thanks I have followed Marshy and Debt star advise and downloaded the FOS details and have started to complete these. Yes absolutely agree this is genuine, as the way the loan was sold in store I was told that I would get good rates and as a good customer I would get a better service and the loan would take 15mins from completing to being in my account, what wasnt advised to me was that I would have a PPI on the loan and that PPI I would be paying interest on therefore increasing my overall monthly commitment. hence why I wish to make the claim. I have a new loan last week from them and this time I was aksed about PPI and I was able to decline this and still get the loan processed, so it was all down to impressions and that my loan would be better with a PPI.
                hope that in your opinion this is relevant to my claim??

                  Hi. I have emailed you my precedent letter. remember, it needs to be adapated but the list of causes for a PPI complaint are given and I suggest you also put these in your FOS form as well.
