    Hi haven't been on here since last year, when I got some really good advice about reclaiming bank charges.
    I'm hoping to get some good advice again. I recieved a phone call last Friday from some one who seemed to know all about me buying my house on the right to buy scheme, they knew that Regency had been involved and asked me who the solicitors were that were involved with my mortgage when I told him who they were he said that we could probably sue them. because there has been quite a few cases where the solicitor had not advised people in there best interest, and had told us that we could get our own Mortgage provider, and also the solicitor had lumped their fee into a home improvement loan which was taken out on top of the Mortgage and is still being paid with interest until the Mortgage is paid.. The company who contacted me are called Heaton Legal They made arrangement for a solicitor to come and visit on Monday (yesterday) which I cancelled and arranged for a later date so I could get some advice. The solicitor is from a firm called Retrieve , The person from Heaton Legal said I could check out Retrieve at the Ministry of Justice website which I did and got a phone number and phoned them they said Retrieve were not solicitors and advised me to get some legal advice but could not advise me to go ahead or not. Has anyone else heard anything about this by the Way Heaton Legal said the solicitor would need £495 up front and 19% of any money if the case was won. Hope someone can help.     Well I think the fact you have looked on the internet to ask about this means your gut instinct is that it isnt kosher, and I would be inclined to agree with your gut instinct.

    So when you took out your mortgage for the purchase under the right to buy scheme did you take extra for home improvements and have the sols fee added to the mortgage loan ?

    Have you copies still of your mortgage agreement etc ?

        hi thanks for replying yes the sols fees were lumped in and i still have copies of mortgage agreement and all paperwork.

            Is it a Home and County mortgage/broker ? ( HMCL )

            When did you take out the mortgage ?

            (was it before December 2006 ?)

            FSA fines mortgage firm £52,500 for management failures

            Other recent action taken against mortgage brokers includes Rainbow Homeloans, Best Advice Mortgage Network Limited, Paramjit Singh Bali, John Vincent Burton, Regency Mortgage Corporation Limited and Capital Mortgage Connections Ltd.

            So I expect customers of those are being targetted by this new CMC too.


            REGENCY was fined for PPI miselling FSA fines mortgage firm £56,000 for PPI sales failures in Sept 06

            Regency's breaches were particularly serious because as a specialist in the "Right to Buy" market, its customer base consists primarily of sub-prime customers who traditionally have limited financial means and access to credit. The risks for these customers are therefore high if they are not eligible to claim on a recommended PPI policy or if the policy is not suitable for their demands and needs. The cumulative effect of the failings in the firm's systems and controls exposed their customers to an unacceptable risk of being sold PPI policies which were not suitable for their needs.
            As a result of the review Regency is carrying out a past business review of PPI policies sold between 14 January and 31 October 2005. The objective of the past business review is to ensure that customers who purchased PPI products from unsuitable recommendations receive appropriate redress.

                Okay these guys are probably then going through the lists of customers of the people who are/were customers of the companies who have been fined for misselling various products, ringing them up and offering to reclaim for a nice £495 upfront fee.

                Of course, as ever, you can do it yourself if you feel you have been missold.

                  I would love to try myself but the bloke that rang me said that it isn't like reclaiming bank charges which I told him I'd done myself last year he said his granny could do that and this was a different kettle of fish and that I wouldn't know where to begin ( which I don't to be honest) Thanks again Bon

                            I've just had a call about exactly the same thing. Heaton Legal are sending out a representative from Premier Legal. I never took out any PPI so my claim would (if I think this is legit) just be about arrangement and sols fees.

                            I did question the chap that rang me that I was aware the FSA had given Regency a final notice regarding PPI fees and that I was not aware of any other action taken against them from the FSA. He did go away and speak to his manager and quote pointed me in the direction of the Final notice issued in September 2006 which under several points suggested that a claim could be made for unfair arrangement and sol fees.

                            He said there would be no upfront costs and it was a no win no fee case, but that the fee would be 30% of the arrangement fee refund only and that I would keep the rest of the fee refund and all compensation etc.

                            I really dont know whether this is legit or not, can anyone help shed any light.

                              Personally I would phone and cancel the appointment, then if you wish do it yourself - that way you get all the money!
