      Sorry have been looking at the other PPI thread. Lloyds puts PPI claims on hold in defiance of regulator - Legal Beagles Consumer Forum

      The FSA are unsure at the moment how lloyds intend putting claims on hold and to what extent. If they want to have a waiver against standard complaints handling rules yes they will have to apply for a waiver (and it will be published on the fsa register and there is nothing), but they dont think they can, and they havent yet, so the assumption is that lloyds are looking at some other way to avoid the FSA regulations on complaints handling. As the judicial review is ONLY questionning the amendments to be made 1st Dec and NOT the current rules, it would have to be a kind of take themselves out from under regulation of the FSA thing, which I wouldnt have thought possible. (although they could possibly utilise the forthcoming breakup of the regulators??) I really don't know, things are moving quite quickly tho.


      With regards the retrospectivity - thats the main thiing they are arguing against. Its the pro active invesigation and refund of all ppi claims.

      I dont see how that affects current claims, although admittedly they may behave differently with current claims (ie pay out) rather than have to go back and investigate and refund further after 1st Dec (if the JR fails), so that could be an argument for a waiver.

        Like trying to get blood out of a stone on personal queries to Lloyds, was hoping for an email confirmation as well - despite the media etc....

        I left them an email last night but they just state to ring.......
