AL59 PPI Claim - Natwest **REFUNDED**

    No I have just been in to the loan account there nothing been added or debited from the balance since October except the payments I make on it I have cheked the balance against my future payments and the time scale works out right 4 years left on it ?

      Just got back from the hearing. Natwest had a young female self employed solicitor there from Leeds,would only have been about 25 so she chatted to me for 10 minutes before we went in front of the Judge explaining what she was about to ask for.
      The judge said he would not strike out the claim just on the grounds that there was not enough Particularity in the POC. He then asked me if the policy was cancelled why were they still taking £24 per month out of my account on top of the loan payment I said you would be better asking the Natwest Solicitor she did not know. I explained that it was something to do with the risk of the ppi at the beginning of the loan. He told me to just cancel it I said it was part of the loan dd, he told me to cancel the dd and set up a standing order less the £24.00. He then said that Natwest solicitor should set me out a Questionair for the particulars of claim that they were enquiring about he set a date in April for me to do this. But then he got into the question of misselling and told me I cannot have a claim on what was not said to me only on what was said to me. Hea said it is not the Banks fault if I did not read the documents before I signed them. He asked me if I had a ppi before I said yes he asked me if I read the document then? I could not remember. He then said we all sign these forms on the day but we should read them He has set a trial date for June 5th allocating 2 hrs. He will be the judge and quite honestly its a gut feeling I dont think I have much chance against him. In Natwest defence they reckon I made a sickness claim on another policy I honestly cant remember but my claim is more about the unemployment side of this policy. As I explained to him a few years ago I had signed contracts for the whole summer season with a well known holiday company 3 wks before I was due to start work they cacelled the cabarets on the ships I asked about my contracts they told me read the small print 14 days written notice of cancelation the letters are on there way out now. I nearly lost my house . I said to the judge if I had that policy I would not have been able to claim. My whole argument was that I had been with Natwest for over 20 years they knew I was self employed and that the Unemployment part of it would not be suitable to me he didnt reply. He just told me what I had to do in the time frame he had given me.

        Ok Al you made it home, they didn't hang you?
        Your case has not been thrown out anyway because of your POC which you thought you had mad a boo boo on, so that's good.
        Think it's best till you get all your paper work from the court, then we can have a look at what exactly the judge has asked from you.
        I also don't think the judge has read the FSA findings and reports on PPI.

          don't be disheartened by that Al - Judges tend only to want to discuss the things relevant to that specific hearing - and the hearing wasnt to question the misselling part of the claim. (apart from his little grumble lol)

          Yes get all your paperwork up on here as soon as you get it.


          Also - sounds like he was confunded with Natwest still taking money.

          Just need to get right down to the basic facts now really and ignore any emotional bits and bobs.

              Hi! Everyone, Just been through your whole post. As I see it the £21 is still in question, yes?. I would suggest, Border Collie, that, if you check your original paperwork for this loan, you may well find that this £21 represents a portion of the 'Interest' that NastyWest charged on the 'Whole Policy' arrangement for you PPI. I think that they are still trying to charge you, probably in full, for your cancelled PPI policy. Check this out and let everyone know.

                Arrived home today to a Notice of Allocation to small claims track (Hearing).
                Basicly giving the times and date of the hearing, also that I now have to pay out another £300.00 by February 27th this will mean I will have layed out nearly £500.00 in costs since the start of this fiasco with Natwest. The letter reads.

                1 The claim to be ammended,toprovide the date withe the plicy now calculated to be 1 March 2007 ( This was already done in the Northampton court when I changed the P.O.C. The Judge must have been reading the old p.o.c )

                2.The Defendant do by 26 February 2008 serve the Claimant and file at Court P.18 questions for further particulars they require by the Claimant.

                3 The Claimant do provide replies to the Defendant- copies to the Court by

                      I think paulindalex has put it better than me. The answer is yes. It is not an additional ppi payment but it is ppi loaded interest.

                        Right here we go

                        The original letter to Natwest I asked for £1589.49 in premiums plus 8% of that ammount £127.15 that was a total of £1716.64 that I asked to be refunded to me. They said no I sent LBA after I read a report in money mail saying compensation and interest could be added to the claim They cancelled the policy for me the letter read.
                        Dear Mr ------
                        I write further to your recent instruction to cancel your loan insurance and can now confirm that this has been actioned as requested.
                        Please note that when you cancel the Loan Insurance your monthly repayment figure will not reduce by the ammount of the monthly insurance payment that is quoted on your agreement form.
                        This is because the repayments for insurance are higher at the start of the loan, due to the risk involved and lower at the end of the loan, Therefore the longer the loan has been operating and receiving benefit of the protector insurance the less the monthly repayments will reduce. As a result the new payment will be £244,71. I have found out from Nattie this is Bull They load the interest on to the loan at the beginng
                        so they are still taking interest on something I dont have.

                        I decided to issue a claim for the full ammount of the premium £3675 thought with interest and compensation it would be around this ammount anyway. As you know I got judgement by default at Northampton they asked for a set aside as they had not received the paper work in time. Then we ended up in my local county court. They called tonight offering £1837.50 plus £100 towards my costs saying that Natwest wanted to save legal costs as we now had a trial date. I have just calculated they have taken £231.00 since the loan was cancelled when they still take the £21.00 If I could get this back as well I would be happy.

                              Today I took the advice of all you lovely people and took the offer from Nastywest as long as they drop the £21.02 for the rest of the loan I would just like to thank you all for your advice and support through this long long fight for my rights We won in the end Thank you so much and I will continue to pop in and try and help in anyway I can maybe even a show to raise funds for the site let me know if I can help once again THANKS!!!!

                                I am so pleased Al you finally got a result that you are happy with.
                                Do not cancel any court proceedings or anything till you have the cash and the the loan payments amended in writing or your direct debt amended.
                                You best had pop in too, as for the show, I am not too sure how many on here can cope with a male stripper to be honest
