    Yes, if not, you will have to claim against the OC/Cardiff Pinnacle.

    Incidentally, whilst searching for Origin, the name Origin Direct (trading name) of 77 Middle Hillgate, Stockport kept cropping up. Looks like they, Origin, when into insolvency.

      Ok, a quick update to this ongoing saga.

      Basically, I've lodged a complaint with FOS giving them all the information that has been provided my myself and others in this thread along with the necessary claims paperwork the FOS require. The complaint was lodged mid-October.

      Earlier in the week I asked for an update, and have discovered that the claim is in the FOS 'casework support area, awaiting allocation to an adjudicator for investigation'.

      The reason for the delay is down to the fact that the broker/finance company are dissolved/were unregulated at the time of the sale, and they are investigating the possibility of going after Pinnacle. They can't give me a timescale on when my claim will be decided as a result of the delay.

      I'm pretty certain that Pinnacle were members of GISC at the time of the sale, as so would be liable to deal with the claim. Is there any way to find this out?

      Starting to lose a little heart now, given that the claim originally was started through a claims firm in August 2009, and now over a year later it seems I'm no further forward and staring at another lengthy delay in getting my claim decided.

      I just hope its worth it in the end...

        As far as I know the GISC are still running to handle complaints before 2005 although they do not seem to have a website any longer.

        There web address was gisc.co.uk which now takes you to Car Insurance UK

        However they do still have an address and phone number:

        Maybe worth a ring to see what the state of play is, it is a labourous task but please stick with it until you do know that you are at the end of the line my bank claim took 2.5 yrs and have only just reached agreement on redress now for nearly £9000.
        If you think nobody cares if you're alive, try missing a couple of payments.

          GISC (General Insurance Standards Council) is the new watchdog established to monitor and enforce standards in all areas of general insurance, including the fair treatment of customers.

          GISC addresses two separate insurance-buying groups:

          individual consumers (private consumers), who are likely to buy products such as:
          • insurance for homes (buildings and contents), vehicles, caravans, boats and for pets
          • travel insurance
          • private medical, dental and personal accident insurance
          • extended warranty and breakdown insurance
          • legal expenses insurance
          • payment protection for mortgages and other loans

          • businesses (commercial customers), buying insurance in respect of a business, eg:
          • employers' liability
          • business interruption
          • goods in transit
          • key man insurance

          (GISC does not regulate life assurance and pensions).

          The GISC Codes (one for Private Customers and one for Commercial Customers) set out standards of good practice which all GISC members must follow when they deal with their customers.

          GISC members are monitored independently to make sure they follow the Codes.

              With both mine and hubby's they were year 2001, and mine was resolved by the FOS almost 2 years ago and hubbys last year, this was via Lloyds TSB, and Credit Card ppi, they were then under GISC.

              So yes they are able to.

                I have had several cases with Lloyds, and the credit card ppi were the only ones out of the lloyds complaints to go to the FOS, they upheld on a few loan ppi's before the JR came into affect, and now another 2 on hold with lloyds.

                      I can understand how frustrating this must be for you, but hopefully despite waiting for them to make up their minds on a possible appeal - with a bit of luck they will continue to get on with investigating cases.

                      They have until the 10 May 2011 to decide, they will possibly wait until the very last minute though.

                      However, I have 2 ongoing cases still held with lloyds via loan ppi and in the same position as yourself, and am awaiting some feedback.
                      I have asked if they would yet be in the position to continue with ongoing complaints since the outcome from last week.
                      I have been informed by email they are unable to provide me with a full response on my query quite yet as they are still waiting for some information.

                      I hope they get back soon with some hopeful news, fingers crossed.

                        Ok, so now seemingly the FOS have started correspondence with the broker. But as its a complex case there will be another delay in adjudication while they continue to investigate whether they can rule on my case.

                        I have to wait another 3 months to find oud.. FFS! That'll take the time they've had my case on their desk to one year, and I still might lose out.

                        Thoroughly sick of this now, tbh.

                          Did you receive one of those standard letters that are received approx every 3 months?

                          I received on from them the other day and it was stated they will be in touch by August 31st.

                              Although I'm not due an official response or update from FOS until the end of August, I emailed them again...

                              I got a reply 2 days later.

                              Dear Mr xxx

                              Thank you for your email. Your complaint is currently in our operations
                              support area awaiting allocation to an adjudicator for investigation.
                              The delays you have experienced with this complaint are due to the fact
                              that the broker who sold this particular payment protection policy is
                              outside of our Jurisdiction.

                              We are still investigating the possibility of raising your concerns with
                              the underwriter of your policy, i.e. the insurance company who actually
                              provided the cover under the policy.

                              When we have more information we will update you accordingly, but due to
                              the Jurisdiction issues, I'm afraid I'm unable at this time to provide
                              you with a timescale for your complaint. Please accept my apologies for
                              this and for the severe delays you have already faced.

                              If you have any further questions, please do not hesitate to contact us.

                              Yours sincerely

                              Word-for-word the exact response I received in my last update letter. My case hasn't progressed an inch in 2 months as the FOS still investigate whether they can go after Pinnacle directly as the insurer due to the agreement being pre-2005.

                              Is there any way - any way at all - to find out whether Pinnacle were ABI/GISC registered prior to 2005 that I can build the case on for FOS to act, aside from outright asking them directly?

                              If I leave it to FOS to find out for themselves, it'll be another year before anything happens...

                                Hiya

                                One of mine is going through the underwriter/insurer of the policy due to the same reason as yours, they will have been regulated as an underwriter so you will be fine there.

                                It will however as they stated take some time though, but they should as usual keep you updated every 2 months.
