    hello every one , first post here .
    i had a loan with the fund corp back in 05 , they added ppi without my prior knowledge , any way after seven overpayments ie with ppi i tel and had it cancelled off ,any way in march of this year i began my quest for a refund ref this ppi , did the usual sar them in march got my statement etc , have kept on at them , not being a total wizz i noticed that my amount that i worked out i had overpaid was down as a journal debit , sent a letter in late oct ref this saying that their hiding the true facts and figures amonst the statement was not on fraud , dubious accounting methods , mis representation amonst other stuff i wrote ,as well as adding comp interest gave them a total i would accept. their reply said they would offer the amount i initially paid without the interest, i do believe i have them over a barrel and sent my reply taking it to the small claims court send the full amount i asked or my next step will be court, now i know they must be fretting a bit bec i have received another reminder of the first offer . my question is i am carrying out my threat and need help ref my poc can i put fraudulent misrepresentation as well as usual mis sold stuff bec i have asked since march and only now have they acknowledged the refund :beagle:

        Hi Amy , Their Offer Is The Amount Paid , And The Second Offer Also Said Plus Interest However It Did Not Disclose The Amount , My Lba Said Contractual Interest Compounded And My Costs Due To Them Mucking Me About Since March And My Having To Take Out Further Loans , Which Had I Of Had My Initial Refund I Would Not Of Needed

            i am not sure because they have not stated the amount or terms ie date from when they start. but the diff between their original figure and my lba was double their amount

              How much in figures (pounds and pence) are you claiming? How much in figures (pounds and pence) are they offering?

                the claim , and the only reason i have been avoiding putting the actual figures down is because you dont know for sure if they too veiw this site , sorry for the avoidence its a combination of age and knowledge but not wisdom otherwise i would not be asking the question, dear alsation
                the figure without their interest and subject of their offer to include interest which was 7.9% 855.00 my cliam in my lba was for 1800

                  Well if they are watching they would probably not be able to make head or tail of it so i wouldn't worry too much on that score.

                  So, you asked for 1800, and they are offering 855 plus 7.9% interest. is that a straight 7.9 or will it be compounded? If it's straight, then what's the point in that as you would get 8% stat s.69 at court. You should work it out on a spreadsheet, the dates of the payments made, and the rate of interest charged, to arrive at a figure of what the totl should be. Then negotiate from there. In my opinion.

                  Thing is, once you have threatend to take it to court, there comes a point when you must actually do so, otherwise they will belive your threats are empty.

                  If you need any help with letters, put your draft up on here and we will have a look at them for you.

                    may thanks , no not idle threat am in the middle of various cases involving ppi and business and personal bank charges as well as just taking a dca at this moment to court ref disputed accounts etc so busy , have e mailed them at the fund corp with 24 hrs notice of intent with the specific version of what i shall be using either fraudulent misrepresentation or negligent misrepresentation , not sure which but on one of them is down to the defendent to prove otherwise , as for the dca the mcol issued last week was for my research and reply letters they invited me to do for them , if you get what i mean . advised them from the outset i would charge em , now getting my money hopefully £300 inc costs wish me luck and thankyou for the fast response and yes once done i will donate thankyou

                      hi , gordon brown here again, sorry to ask , in my poc do i have to put cpr s in ref my claim or just detail it all out ie 1 2 3 etc and at the end put what i seek ref example damages restitutionary damages etc and the amount and total and also could you help me ref my poc do i quote the cpr specifics or just in general, and ref the above the funding corp from march to oct denying a refund was due then after further investigation by myself i discovered the amount paid for ppi hidden in the statement, now my question legal beagles and you were highly recomended is can i put /do i put fraudulant misrepresentation negligent misrepresentation or professional negligence .

                          Your PoC needs to be as full as possible, but without becoming a re-write of War and Peace.

                          It needs to particularise your claim and be succinct, yet factual.

                          Post it up and we'll take a look for you.

                            thankyou and do i refer to cpr or just speel it out , and think i am best to go for professional negligence dont you , bec they should of known better,

                              28 short peragraphs is that ok , it aint war and peace is it , no mention of cpr , just as it says a brief poc , not to be compared with my motely crews claims for expenses lol only wrote in rough will do actual one tom in the court , then if suc will post ok 4 pages not to bad is it
