Re: La Redoute PPI
Curlyben has already written a very good letter when you are supplied with a non-compliant CCA.
I have edited it for you:-
Thank you for your recent letter sent to me dated **DATE**, the contents of which are noted. However, the reply received does not in any way fulfil your requirements under the Consumer Credit Act 1974.
The Act demands that I be supplied with a true copy of any properly executed credit agreement that exists in relation to the above account. I may ask for this on demand.
My request remains outstanding. To claim that you have sent me an agreement that I “would have signed in accordance with advice given to her at the time she established her home shopping account with La Redoute” is simply not good enough and as such the supplied documentation does not constitute a true copy of a credit agreement. The agreement you sent does not contain all the prescribed terms and is not 'properly executed'. The statements sent do not correspond to the amount stated in your earliest correspondence and therefore they do not satisfy the requirement to supply me with a statement of account.
The time limits, which are laid down in the Consumer Credit (Prescribed Periods for Giving Information) Regulations 1983 are clear. You must supply an executed credit agreement within 12 working days of a proper CCA request. If you fail to comply with a legitimate request the account enters a default situation and if you fail to comply after a further 30 days you commit an offence.
Further to your attempts to fob me off with such a poor excuse of an agreement, I take issue with the entire tone of your letter. I am well aware that I have purchased and paid for goods on the above account and accept that I have an agreement with you, I merely wish you to send me a copy of the agreement I signed and I may do this at any time providing that a fee of £1.00 is paid. This fee was sent with my original letter, dated 26th August 2008.
I look forward to receiving the information I have requested.Last edited by Amy; 6th September 2008, 17:40:PM.

Re: La Redoute PPI
For your SAR:
Thank you for your reply to my formal request for my information under s7 of the Data Protection Act 1998 dated *********.
Whilst I thank you for supplying me with copy statements from (date) to (date) under the Data Protection Act 1998 you have an obligation to comply fully with my request and you must do this within 40 days. If you are in any doubt as to what your obligations are, please refer to my original letter to you dated 26th August 2008.
If you do not comply fully with my Subject Access Request by XX/XX/XXX , I will begin a County Court claim in order to enforce compliance. My claim at that time will include damages at the discretion of the court.
I look forward to hearing from you.

Re: La Redoute PPI
Got a reply to my (Amys!) letters
"Whilst we agree there is no credit agreement and the debt is noot enforceable it does not alter the fact that you ordered, accepted and kept gooods which have still not been paid for and we have cleared the outstanding balance. as a responsible lender we agree to keep the credit reference agencies up to date on how our customers manage their accounts with us. If we did not record this information ,the information would be factually incorrect therefore we will not be removing the registration."
I never asked for the debt to be written off ,I never asked it to be I just wanted the agreement to show I hadn't asked for PPI and statements to calculate how much.

Re: La Redoute PPI
But I didn't ask them to write it off and now I will have a default or have I read the letter wrong?
Don't get me wrong to have the balance cleared this way is a lot quicker than claiming back PPI but I don't want a default because of it.
Thanks for all your help with this result Amy xLast edited by pinknico; 12th September 2008, 19:29:PM.

Re: La Redoute PPI
I would be inclined to write to them again and point out that this is not good enough, again. You are happy to pay what you owe and having the debt written off was not your intention. Ask them to clarify exactly what they have registered with the Credit Reference Agencies and remind them that they still need to comply with your SAR.
