    Please could someone offer me some advice.I sent the standard letter to La Redoute catalogue asking for a copy of my loan agreement and statements with a list of charges and account cover payments with a view to reclaim and received a very snotty letter.

    Dear Sir/Madam,
    Thank you for your letter
    I attach a copy of the standard agreement which your client would have signed in accordance with advice given to her at the time she established her home shopping account with La Redoute.Your client(?) appears to act in a way which indicates that an agreement was signed as she has conducted the account for sometime by placing orders, receiving goods, returning goods within the approval period and making payments.Copy statements showing all transactions are enclosed.These enclosures satisfy the requirements of section 77-78 of the consumer act 1974 in regard to supplying a copy of the agreement and account statements.
    I must however correct your statement that we are under obligation to provide a facsimile copy of a signed agreement. The regulation only require us to provide a copy of the agreement and it is not necessary to provide a signature box. I refer you to regulaton3 Consumer Credit(cancellation Notices and copies of Documents)Regulations 1983 (SI.No 1557).

    I feel like I have been threatened in the last statement and is it true I can't expect my signed copy and how what about proving I agreed to account cover there is no mention of account cover on the agreement sent to me but I know now i've been paying it. Also they have only sent a years statements and I have had this account for much longer.

    Any help gratefully received!!

    Which 'standard' letter did you send?

    The SAR or the CCA or both?

      In addition to Amys question can I ask where the PPI element comes into it as there is no mention of it in their response.

      Are you trying to claim back PPI or are you disputing the debt based on CCA regulations?

        I sent a letter asking for a fully comprehensive list of late payment charges ,a copy of my original credit agreement and a list of account cover payments over 6 years and sent £10.

        I have received a photo copy of a present day agreement and a print out of 1 years statements. I have made no claims yet.

        I cancelled the account cover in May when I rang and asked what it was, having not asked for it and finding out it was optional.

        I was requesting the information in order to see where I stood, no mention of a claim was in my letter.
        This not a loan but a home shopping account so I may have started this thread in the wrong ssection, sorry.

          Do you have a copy of the letter you sent

          Did you actually state that it was a 'Subject Access Request' under the Data Protection Act.

          If not they will have probably put the £10 towards your account and sent you what you got.

          Once we know what you are trying to achieve we can move the thread if neccesary.

          Are you trying to claim back any charges, claim back PPI, come to a installement plan to pay it back, or a mixture?

          It would be helpful if you can break down exactly what you have down to date, and what coreespondance has bent sent and recieved

          Then we can get you sorted out and point you in the right direction

            My letters said Iam writing to request a fully comprehensive list of all late payment charges I have paid over the last 6 years.
            Please find enclosed a cheque for the maximum statutory charge of £10.If you are unable to provide this data, I will accept a copy of my statements going back 6 years; I understand statements on their own are not covered by the data protection act, but I am not requesting these but the charges which I am entitled to by law.
            If you store any of the older records on Microfilche please be aware the Information Commissioner deems this to be a relevant filing system under the act.As such any microfiche data must be sent to me in fully and legible form.
            I look forward to your response in 40 days as La Redoute is obliged to reply under the Data Protection Act.If not I will seek remedy from the information commissioner.
            In the same envelope,
            My other letter said:
            I am writing to request a copy of my original credit agreement with La Redoute and a fully comprehensive list of all the insurance charges added to my account with La Redoute. If you are unable to do this I will accept copies of my statements . I understand these are not covered by the dpa but Iam not requesting statements but charges which I am entitled to.
            I look forward to your response etc etc...............

            I have had the account for over 6 years.
            I want to claim back account cover insurance which I didn't ask for.
            I want to claim back any charges for late payment

            I am up to date with all payments and only wanted the agreement to see if I'd asked for account cover.

              For starters it's not sufficient to say here is the agreement that "you would have signed." It's also not sufficient to send you one year of statements when you have requested all your data.

              I would write back to this person and point out their failings if I were you and while I was at it I'd insert a paragraph letting them know I don't care for the tone of their letter.

                  I was successful in claiming all PPI payments from Littlewoods, like you I had never asked for it and didn't realise I had it until they sent the insurance policy 2 years later ( I know I should have queried the statements but only looked at the amount to pay each month).

                  So good luck with this it can be done

                      Thanks for all the replys, I feel a lot more positive now and will follow this up to the bitter end.

                      Thank you for the letter Amy, you're a star.

                      I can't make a claim until I have the information.
                      La Redoutes proprietor is Redcats (Brands) Ltd and they have been fined so maybe this is just a stalling technique.

                            I think we need two separate letters, one for the SAR and one for the CCA.

                            Did you send two separate letters when you requested this information?

                              Hi Pinknico, this sound very familiar to one of my battles with Studio catalogue.

                              If you ask them to provide you with a statement of account. You can ask them for this (usually for free) via their contact us page here.Redoute


                              In the box where it says:-
                              Your message *
                              You can enter up to 500 characters.

                              Simply ask them for a full statement of account since its inception.

                              As Amy rightly says you may need to then send further letters once you have totalled the charges imposed.
