    Hi again, Thanks EXC I had added relevant details to the Subject Access Request you suggested and I have sent it recorded delivery to Bank a Smart today, I will forward on to you guys any documents they send to us thanks again for your help.

      Hi again EXC finally heard back from Bank Smart regarding our Subject Access Request, I have emailed it to your info email address please confirm you have received it, sorry it in picture format haven't had time to get to Post Office, the subject Access Request doc is 34 pages long and also a pic of letter from Bank Smart last month let me know if any pages missing and I send them in, please could you advise my next move as I still think it unfair that Bank Smart have ended up with 2 thirds of my mums PPI claim. I also think my mother wasn't aware of what she was singing and just went along with whatever they asked without knowing any better. I look forward to hearing back from yourselves and thanks again for your assistance with this matter,

        Just to confirm the main point first - the original sign up sheet details claims for BOS, Burtons and Dotty P (Genworth).

        They have confirmed they have cancelled the Dotty P (Genworth) claim to bring an end to the matter, but disagree any money is due refunding.

        They also confirm the refund from BOS was £3318. They don't mention their miscalcuation so I think we should write to them about that.

        Gerry's Mum paid £ 1323.63 when she should have paid £1006.40 MAX.

        25%+VAT of refund from HBOS - REFUND £3318.40 - Fee = £829.50 plus VAT@20% = 995.40 Plus (dubiously) £11 document request fees = TOTAL DUE - £1006.40

        That's before we get to the 'breach of contract' invoices which she paid to try and get them off her back.

        I think formal complaint about the breach of contract charges and the overcharging of commission on the HBOS claim would be a good start to go over to the FOS ?

                      I've seen all the docs you sent and agree with Amethyst on the overcharge on the commission for the HBOS refund.

                      You obviously complained to Bank Smart as they have sent you a complaint rejection response dated 25 November so our next step is to take the complaint to the Legal Ombudsman which I can help you with but firstly can you send me the original complaint that you sent Bank Smart? Also can you send me any letters or e-mails from you mum to Bank Smart asking for them to cancel the claims?

                        I've got majority of the docs so will have a look through them xx Okay I've only got the letters back from BankSmart etc. Not the complaint made to them or any letters/emails sent.

                          Hi EXC Happy New Year to all the team at Legal Beagles.

                          Sorry about delay in replying been hectic, anyway in response to your last post, their was never an actual letter of complaint written.
                          My mother was getting frustrated with Bank Smart sending letters to her for up to 2 years after the initial claim was made.

                          The cancelled claim was done over the phone by my sister as mother was getting increasingly annoyed with their communication and she wasn't sure
                          what companies they were investigating and why claims were still on-going after original settlement. my sister advised Bank Smart over the phone that
                          as far as my mother was concerned their business was complete, at this point my sister and mother were unaware of cancellation fees and were not made aware of them whilst on the phone, soon after this is when Bank Smart sent invoice for cancelled claims, which my mother paid and thought
                          that was it finished. Bank Smart continued to write to my mother and whilst I was visiting her she explained to me what had been happening.
                          I was disgusted to find that Bank Smart had ended up with more than two thirds of mothers PPI claim back and thought this to be unfair and that is when
                          I contacted you guys at Bank Smart to help me draft a complaint letter. Whilst I was getting the documents to your team Bank Smart had been in contact again and I had to phone them (03/10/16) and advised them to stop any communication with my mother where I also advised them I would be making a complaint on my mothers behalf and as instructed by yourselves I sent them the Subject Access Request. After this another letter was sent to my mother on (22/11/16)
                          I called them again and advised them my mother was a disabled pensioner and that they were taking advantage which the admin assistant denied. I cant find the Subject Access Request I sent at this moment as I use 3 to 4 different computers and searching each one when possible I will send it hopefully shortly.
                          Thanks again for your assistance please let me know where we go from here.

                              Hi EXC I don't know exactly when my sister contacted them and cancelled but I can estimate it was around
                              the start of June, If you check documents I previously sent there is a bill which was sent to my mother only 2-3
                              days after my sister cancelled which will give you the date within a day or 2, I have a receipt from when my mother
                              paid the cancellation fee and it is dated the 18/06/16 so maybe few days or up to a week before that.

                              I also haven't got the subject access request I sent as I typed it up and printed it in my local library and didn't save it, but there was
                              never an official complaint letter sent, so what I think they have done is taken the complaint from what I said over the phone and
                              responded to that.

                                Sorry me again, I have found notes that state I notified Bank Smart of my intention to make a complaint against them in relation to my mothers claims on the 03/10/16 at approx. 15:55.
                                31/10/16 Subject Access Request sent recorded delivery
                                22/11/16 at approx. 10:30 phoned them and complained after another letter received (think this phone call is when they have noted it as complaint)
