      Claims Management Regulator Fact Sheet – Suspended or cancelled business

      If a claims management businesses authorisation has been suspended or cancelled it means that it will no longer be able to carry out any claims management services. As a result they will not be able to continue assisting consumers with their claims. If you find yourself in this position the following guidance might be helpful.

      What will happen to my agreement with the business?

      If the claim has not been completed you might be entitled to repayment of any fee. You should contact the claims management business immediately stating you are aware they are no longer able to provide the service as agreed with you and seek a refund of fee for any work not completed. If you have a ‘conditional fee agreement (CFA)’ with the business you might be entitled to repayment of the entire fee. A CFA means where the business has guaranteed they would refund your fee if your claim was not successful.

      I have entered into an agreement within the last 14 days?

      All clients who have an entered into an agreement are entitled to a 14 day cooling off period. This means you can cancel the agreement and request a refund of any fees paid. You should contact the claims management business as soon as possible informing them that you wish to cancel.

      I paid for the service by credit card, what should I do?

      If you did pay by credit card and the claims management business is no longer able to provide a service, you may be able to seek a refund direct from your credit card company. You should contact your credit card company and they will be able to advise if you have a claim. Consumer Direct also has useful advice on how to request a refund.

      I paid for the service by debit card, what should I do?

      Some banks and building societies operate voluntary schemes similar to those for credit cards; you will need to contact your debit card provider for further information.

      I have paid in cash, by cheque or banker draft

      If you have paid by any of the above means then you will not be able to recover the fee you paid other than to write and ask the business if they would be prepared to refund you if they have not provided the service or they are unable to provide the service as they are no longer authorised.

      My claim has been sent to a third party (loan provider or solicitor), what should I do?

      Contact the provider or solicitor and ask them to deal directly with you about your claim as the claims management business is no longer authorised. You should also write to the claims management business at their registered office address and lodge a complaint as they are no longer able to deal with your complaint. This may be helpful if the business goes into liquidation as your claim for a refund of fee, partial or otherwise, can be registered with the administrators.

      My claim has been sent to the Financial Services Ombudsman?

      If you know that your claim has been sent to the Financial Ombudsman then they will already have the claim documents. There is no need to contact the Ombudsman as they will contact you in due course. If you are not sure if your claim has been referred to the ombudsman please contact then to confirm they have details of your claim.

      Can I take any other action against the business?

      You might have a right to go to court for breach of contract, if a claims management business is no longer authorised. We would strongly recommend that you seek independent legal advice before taking any court action. Details of providers of free legal advice are below.

      We would advise you to put any requests in writing and to send all letters by registered post or obtain proof of posting. Always keep copies of all communications including letters or emails and a record of any telephone calls.

              Be careful there is so much misinformation on the web, in particular I refer to the comment that if the solicitor failed to obtain ATE insurance the client will have to pay legal costs. Absolute rubbish I'm afraid as that amounts to negligence & the Law Society will have to cough up NOT the consumer ......... but then more than likely they'll be scrubbed after all it's just lawyers charging themselves via the fund

                This does not make a lot of sense that there is a debenture for this multitude. It seems at Companies House that two separate charges were were secured on the assets of the company. To see exactly what these were someone would have to pay to get that information from Companie House. It would be very interesting to see what these debetures were for?

                I am very sure a very sure that we will all be keeping a very close eye as matters develop in the coming weeks.

                            Quite but I think all that's needed to rock their boat, & avoid the accusation of libel is to point out the connection (without comment) between them & the now defunct Cartel Client Review namely Mr Wright should be enough on it's own to get consumers scurrying for the hills I think

                              CLAIMS STANDARDS COUNCIL WELCOMES MoJ DECISION TO SUSPEND CARTEL CLIENT REVIEW

                              19/03/2010


                              The Claims Standards Council (CSC) today welcomed the decision by the MOJ to suspend Cartel Client Review Limited’s (CCR) authorisation, thereby preventing it from offering any further claims management services to members of the public.
                              “It is unfortunate that the MOJ were not in a position to act earlier, but they needed to establish a prima facie case before any action could be taken rather than rely on hearsay, rumour and uncorroborated comments from former staff” said Anthony Sultan, Chairman of the CSC’s financial division.
                              The CSC had voiced serious concerns to the MOJ over some considerable time regarding the efficacy of CCR’s business model which entails taking substantial up-front payments from clients. CCR also encouraged clients to become introducing agents on payment of a further fee. The CSC further voiced its concerns over CCR’s influence on Consumer Credit Litigation Solicitors (CCLS) – a solicitors practice which handled virtually all claims on behalf of CCR’s clients.
                              CCLS was closed down earlier this week following intervention by the Solicitors Regulation Authority.
                              “We have two key concerns at this time” states Sultan. “Firstly, what has happened to clients’ money and secondly what will happen to the tens of thousands of claims that CCR’s clients have against various lenders ?”.
                              “Without authorisation, CCR cannot continue processing these claims or even refer them to another CMC” says Sultan. "In effect, the contracts between CCR and their clients have been ‘frustrated’ " he adds.
                              As such, the CSC suggests that clients may be able to request a full refund.
                              “This is very much a ‘one-off’ situation” adds Sultan. “Unfortunately, it tarnishes the reputation of the many first class claims management companies that deliver a great service to their clients, successfully obtaining redress from the lending institutions who have breached the law and/or mis-sold financial products to consumers”.

                                The following will give any Agent / Master Agent who wishes to pursue a claim against Grass Root's for outstanding commissions along with the other readers of this thread some interesting information !

                                This company first came to prominence following the dispute that arose between Cartel Client Review Ltd and Geo Financial Solutions Ltd (who provided the DMP solution for Cartel ) in late January / early February 2009 .

                                Grass Root’s Financial Ltd is currently owned by Eric Webb ( along with his wife Sandra )who is a Master Agent for Cartel Client Review Ltd and a trusted member of Carl Wright’s “inner circle” .

                                Towards the middle of February all Agent’s / Master Agent’s were informed that they would not be paid for any work placed with Geo and that to ensure that commission payment’s was made it was suggested that client’s transfer their DMP to Grass Root’s .

                                To ensure business was placed with Grass Roots all Agent’s were given the incentive of “double commission” on all new DMP’s placed with Grass Root’s throughout March and April and would be paid for such in late May 2009 .

                                In May 2009 when payment was due to the Agent’s there was uproar when none of them got paid their commission on the due date .

                                The reason given was that Grass Root’s were unable to pay their Agent’s because none of them had signed a contract . The contract that the Agent’s had been expected to sign had quietly appeared unannounced on Cartel’s SOUP system some two days prior to the commission payment being due .

                                To place business with Grass Roots it was conditional upon the Agent also being an Agent of Cartel Client Review Ltd as you would only be able to access the Grass Root’s system via the Cartel system . Effectively Grass Root’s and Cartel Client Review were Siamese twins joined by the one heart the - SOUP system .

                                Some months later it was suggested that Grass Roots would not accept any DMP’s that had been supplied by an Agent from the 1st October , 2009 if the Agent had not previously paid £70 to go on a Grass Root’s training course . Though many Agent’s came from an IFA background many others also came from careers in the Debt Industry and knew more about DMP’s and IVA’s than what Grass Root’s did .

                                Throughout 2009 as many Agent’s and Master Agent’s were placed in a position whereby they had claims for Unfair Dismissal against Cartel Client Review after being "cut off the system" by default they consequently also simultaneously now had claims for Unfair Dismissal against Grass Root’s .

                                To date there are possibly many hundreds of claims potentially against Grass Root’s for outstanding commissions and also unfair dismissal .

                                Unlike many other DMP providers Grass Root’s had paid an introductory commission based on the first months payment to the Agent and had informed the Agent that they would be paid another payment each year based on the payments made in respect of each DMP they had submitted on the 19th December .Most other DMP providers pay an upfront fee based on the first payment and then monthly payments thereafter .

                                This payment would be equal to 25% of Grass Root’s monthly management charge of 17.5% multiplied by the number of payment’s made by the customer in the DMP .

                                If you believe that you have suffered a financial loss as a result of placing business with Grass Root’s then the following information will be of use to you . Having perused the Agent’s contact which has been attached I am of the opinion that is seriously flawed .

                                In addition it can be argued that many Agent’s who placed business with Grass Root’s prior to the publishing of such contract already had an agreement in place by association .

                                The following solicitors specialise in agency law and should be able to help you formalize a claim for any monies that are due to you and act on your behalf . Effectively as Cartel Client Review Ltd claim to have trained over 4000 representatives over the last 2 years there could well be many of hundred’s of representatives owed a great deal of money by this company already .

                                And surprise , surprise Grass Root's are rumoured to be about to launch a recruitment drive following their application for a MoJ licence in November 2009 - as the saying goes “when one door closes another one opens !”
