Please make a complaint to the Ministry of Justice, I have just made a complaint myself againt another claims management company and let us know how you get on.

Following an email I sent to Toni Sargeant I have had this response.

Hi Julian,
Thank you for the below email, I have spoken with Mr xxxxxx and he is happy to continue with us.

The individual that made the sale to Mr xxxxxx was dismissed last week, which again has sent out a clear message to the floor that if you are not compliant you will be sacked. With regarding to the bad customer service he has received, I have a list of all the individual he has spoken to and you can be assured that the calls will be listened to and appropriate action will be taken.

From now on Mr xxxxxxx is going to deal directly with me.

I can’t access the site for some reason so I have got IT looking into it for me, once this is resolved I will be able to post some responses.

Once again thank you for making me aware.

Hi Toni,

Many thanks for that, very much appreciated I am sure Mr xxxxxx will be most pleased with your prompt response.

I will post up your email on the thread so our members can see that Total Refund are taking a proactive approach to dealing with customer concerns.

As for problems accessing the site if it is a login problem please let me know and I will resend your login details to your email address. If I can be of any assistance to your IT Department, again let me know.

It's great that the new regime is looking into and taking action over the misleading calls and claims, but is there something they can do, that cannot be done by the individual? Obviously they are not a charity and will still want paying, and that kind of goes against everything we beleive in?
If I'm missing something then let me know.

It does go against what I would like to see yes.

However, I am not so naive as to think that everyone will either find/use the many forums, have the ability/will to do it themselves. In my perfect world everyone would do it themselves, for free, with assistance if need be from forums, CAB, CCCS etc etc, but it is never going to happen.

There will always be many many people who use CMCs, being resigned to that fact then the next best option is to ensure that they behave in accordance with regulations, guidelines, Law and common human decency.

The ones that provide an unfair or misleading service should be brought to task, the MOJ etc should penalise them and I believe that we can play a part in monitoring or reporting anything we see to the contrary.

I personally would not touch any of them with a bargepole, I have learned so much from the people here and when I first started OTR and to them I will be eternally grateful, yet not one person has insisted I pay them for that service (barring asking for a donation, but thats another story I wont go into)

I agree - I'm tearing my hair out at the moment as a family member hasa claim in since sept 07 with lloyds for around 18k and has just signed up with a fee paying debt management company for £25K and charges of 17% per month - was too embarrassed to tell me how bad things had got. Just makes me mad that they are being charged for something I could so easily have done for them or tried the hardship route. They were told by DMC to forget getting charges back it will never happen!

Hi Folks

I found this site via good 'ol Google and joined to ask a question of you enterprising people.

I work as MD for a small SME, one that is short of staff and long on hours!

I get on average 10 pre-recorded messages from Total Refund. They do not include a callback number (which I believe is against some code or another)

We don't have time to answer unsolicited calls like this and I'd like to know how to get back at them!

Any ideas?

I have written to Toni Sargeant a three-page letter re Cancel Your Loan's methods. Up-to-date, they have put £3,655 over two of my credit cards. One of their agents phoned me early June and I was stupid enough to give details of a few of my credit cards. In July they promised to put back money but nearly three months later nothing has been done. I sincerely hope that Toni will help me because I feel depressed and disheartened at such a large sum of money being taken and which I will struggle to pay.

Ouch that is a lot of money. Was that amount the amount you agreed or has it just been skimmed off your cards ?

Did you have the price and agreements in advance of them taking the money ?

Toni was their compliance officer although I don't know if she is still there. They are still trading so you won't get any joy from the credit card companies. In the contract is there a time period mentioned in which certain things would be done ? Some of them give 3 months, which you arent quite through yet.

All you can do for now is keep writing to them, visibily cc'ing letters to the MOJ and the OFT as well, which might kick their bums into letting you know what's going on.

Regulator shuts down 200th rogue claims firm

Two hundred rogue claims management firms have now been closed by the Ministry of Justice.
The 200th case for the claims management regulation unit highlights the ongoing success of its efforts since it was launched in 2007 to protect customers from firms which breach rules and put their money at risk. This includes companies who offer to help people with personal injury compensation claims and with attempts to get their debts cancelled.

At long last getting help from MoJ re the £3,650 Cancel Your Loan took from two of my credit cards. One Credit Card Company is helping me, the other will not. Toni Sargeant has left the company after just a few months. I wonder why?
