Just thought I would post an update, having been chasing Cento client for something in writing before agreeing to pay the £300 they asked for to pass 3 of my accounts to Forbes DouglasI have now received a letter from them dated yesterday stating (and I dont have a scanner so sorry I've typed it)
"We have conducted our preliminary assessment of your potential claim/s and we can confirm that we are able to provedd with the claim/s process for one or more of your claim/s. This means we can now pass your claim/s to our agents at LEGAL REDRESS Ltd who specialise in handling financial claims. LEGAL REDRESS will act for you as our agents, we have chosen them because of their track record in getting our clients compensation payments quickly and efficiently"
They have sent some confirmation forms for info previously sent and a letter to sign which they will send to the Financial Ombudsman Service.
No request for additional payment.
Anyone heard of LEGAL REDRESS Ltd?
Off to read the 2 pages of small print now!!!

I have copied this from the MOJ site, especially the bit about cold calling. Cento and they cold called me as well as many others that had calls from them. They know it is wrong but they still continue to do this.

Claims Management Regulation – Annual Review 2008/2009 & Impact of Regulation Assessment – Update
The Ministry of Justice has today published two documents, the Annual Review 2008/2009 and a separately commissioned Impact of Regulation Assessment, which is an update of the previous year’s Assessment. The Annual Review highlights the achievements of regulation, changes within the claims management market over the last year and identifies areas requiring focus for the forthcoming period. New measures to protect claimants from unregulated 'no-win, no-fee' agreements
The Ministry of Justice has taken a major step towards protecting claimants from unfair 'no-win, no-fee' arrangements. Proposed new powers in the Coroners and Justice Bill will ensure that claimants are made aware at the outset of how much their claim is likely to cost. New warning to businesses on taking up-front fees and cold calling
In response to complaints received from consumers, we are reminding claims management businesses about the rules about taking "up-front" fees and "cold calling". The attached Warning sets out the details and should be read by all businesses and particularly those dealing with Unenforceable Consumer Credit Agreement claims. We have been working closely with the OFT to address malpractice in this sector and this Warning is issued in conjunction with an OFT press notice issued today at http://www.oft.gov.uk/news/press/2009/72-09.
Unenforceable Consumer Credit Agreement cases – Update
The Judicial Communications Office has issued a statement in light of the activity surrounding the recent case heard in Chester County Court by His Honour Judge Halbert and the speculation and misreporting which followed the hearing. Contrary to some reports, there is no general stay on cases challenging the enforceability of Consumer Credit Agreements.
Cases of this type will therefore continue to be heard and decided on their own particular facts, although the Court may group similar cases for trial, where appropriate, in an effort to save costs and time. Further consideration is also being given to the transfer of selected cases to the Commercial Court in London for definitive ruling where new questions of law have been identified. This is from the OFT web site and if I am reading it correctly that any Claims Management Company giving advice would need a Consumer Credit Licence and it is a prisonable offence to be trading without one.

OFT warns consumers about 'debt sale' scams

The OFT is warning consumers not to be taken in by businesses claiming to help them become debt free by 'buying' or 'selling on' their debts.
The warning follows a significant increase in the number of adverts on the internet and in newspapers from debt and claims management companies that misleadingly state they can take over liability for debts or write off debts by purchasing consumers' credit agreements.
In fact the law does not allow the sale of debt without the lender's permission and so businesses that suggest otherwise are making clearly misleading claims. Brokers who introduce clients to debt and claims management companies that say that they can 'buy' and 'sell on' consumer debts are also misleading consumers.
Consumers need to be aware that if they 'sell' their debts to one of these businesses, either directly or through a broker, they will still be liable for their original repayment obligations as well as losing the money they paid for this false service.
Consumers will also still be subject to any debt collection activity and negative credit scoring associated with the original debt.
The principal regulator for claims management companies is the Ministry of Justice. Those businesses that operate in the credit/debt sector also need to be licensed by the OFT. Some of the firms offering these services do not have consumer credit licences and the OFT is working in partnership with local trading standards services to prosecute them for unlicensed trading. Formal licensing enforcement action has already been initiated against licensed companies whose advertising or websites are making these misleading claims.
Ray Watson, OFT Director of Credit, said:
'Like most scams, when something looks too good to be true, it usually is, and this is certainly the case here. You cannot simply sell on your debt and its liabilities, and businesses that make misleading claims to the contrary are just trying to take advantage of consumers' distress.'
'The OFT will not hesitate to take swift action against businesses which deliberately mislead consumers.'
'Consumers with debt problems should contact their creditor to arrange a repayment plan or their local Citizens Advice Bureau who will be able to provide free advice.'
NOTES
1. The Ministry of Justice (MoJ) is the principal regulator for claims management companies but businesses that operate in the credit/debt sector also need to be appropriately licensed by the OFT. The Consumer Credit Act 1974 (the Act) requires most businesses that offer goods or services on credit or for hire, lend money to consumers, or offer debt purchase, debt counselling, debt adjusting services or credit information services to be licensed by the OFT. Even if a business does not offer credit itself, but introduces clients to sources of credit, that business may be engaging in credit brokerage activities for which a consumer credit licence is required.
2. It is a criminal offence under section 39(1) of the Act to carry out any activity that requires a consumer credit licence without such a licence. Under the Act, unlicensed trading is punishable by a fine, imprisonment, or both.
3. Businesses providing claims management services regulated by the MoJ are required to follow strict rules of conduct including a ban on misleading marketing, high pressure selling and cold calling in person.
4. In August 2008 MoJ issued a joint consumer alert with OFT encouraging consumers to consider their position carefully and get independent advice and in February 2009 published fresh guidance on the type and content of marketing considered to be misleading. A number of businesses have been directed to change their marketing.
5. Today, MoJ has issued a further warning on marketing issues and the threat of enforcement action against any authorised businesses which fail to comply with the requirement that they must provide consumers with clear information about the options available for pursuing their claim, the realistic chances of success and the expected costs of doing so before any fees are charged or a contract is signed. 6. Consumers can check whether a business holds an appropriate consumer credit licence by searching the OFT's online consumer credit register.
7. For advice on dealing with debt, see the Directgov website or visit your local Citizens Advice bureau.

The business Client Connection Ltd, trading as Cento Client Review are regulated by the Ministry of Justice in respect of claims management activities under CRM16588. Any business who wishes to provide claims management services must be authorised under the Compensation Act 2006. Therefore regulation under the Ministry of Justice is not an approval scheme nor is a recommendation, it is a necessity by law.
As with any goods or services it is prudent to shop around and research to satisfy yourself that you want to use this kind of service and that you would benefit from it. If after you have done this you feel you wish to contract with a claims management company for this type of service then there is an authorised business search on our website www.claimsregulation.gov.uk.
Our general advice to consumers is threefold:
- To do some research online, using web sites such as Money Saving Expert www.moneysavingexpert.com. This will help you decide whether the service offered is one that is appropriate for you.
- To shop around. There are a lot of businesses offering such services. Shop around for a business which offers a service which best suits you.
- To be sure what you are agreeing to before signing a contract or making an up-front payment.
In respect of businesses offering to write off consumer credit, I would also recommend reading the recently-issued consumer alert, issued jointly by the Ministry of Justice and the Office of Fair Trading, regarding unenforceable credit agreement claims:

You can actually make a claim yourself using this site and it is free to use the resources and help and the bonus is that 100% of your win belongs to you and not shared with a third party.
If you did take out PPI it is possible to reclaim this, but only if it has been missold.PPI - payment protection insurance - Legal Beagles
You can also claim for Bank, Credit and Mortgage charges. Bank charges though are currently held up because of the test case, but if you are in hardship then there still is a way forward on this. http://legalbeagles.info/forums/forumdisplay.php?f=106

today i too recieved a cold call from cento telling me about missold loans etc,i have previously set up an iva and this info gets put on a list of defaulters that just about anyone can access so cento would certainly see it.they asked me for 149.99 to check and see if mine loans were missold and they told me that the money was only a deposit that would be refunded if they couldnt help.made no mention of any further monetary deposits only to me if they found in my favour.i thought 149.99 sounded good if it cleared the 60k i am in debt for but i see in the threads that it appears to only stem from using ppi's.i had payment protection insurance on my loans but it didnt appear to be anywhere close to the figures in a previous post.has this company cleaned up its act .my iva manager says there are genuine companies that can help but also the recession has seen a boom in non legitimate ones who take the money and run.i have emailed the moj to see what they say

I have not had a response from the MOJ so I sent them a further reminder of my complaints with a few more additions in light of Forbes response.
1. are they allowed to cold call consumers, as they did in my case and many
others. Bearing in mind I and others who they called were x directory?
2.are they allowed to advise consumers to stop paying their loans and pay the
solicitors instead?
3 are they allowed to refer to Forbes Douglas as their solicitors when indeed
they are another claims management company?
4. are they allowed to say that when asked, where did they obtained my
personal data from - they stated from the FSA, when questioned further they
said from a central data base for PPI. - This in my case is not true as I
never would have taken PPI. As being self employed I have always declined to take this option?
5. are they allowed under the data protection act to speak and discuss about my afairs to a third party without my approval?
6. are they allowed to quote figures out of the sky in order to sell their services as
they did in my case?
7. Do they need to be licenced by the OFT?
8. Can you please explain at an inspection of a licence holder how do you
access that they are fit for business?
9. Can you confirm and back up Centos claims that there are 18 flaws in the CCA
1974, relating to mortgages taken out between 1975 and 2005?
10.can you confirm that you did a recent inspection at Cento Client Review and
that they were fit for business?
11.can you confirm what date this inspection took place?
12.can you confirm how many complaints have already been filed against

What kind of claim would offer you 25% of the loan value ?
3 credit cards, a dead loan and a mortgage
Credit Cards - unenforceableposs, could have PPI (reclaimable if missold) - could have late payment fees (reclaimable)
Dead Loan - could be deeed unenforceable but then whoop its dead anyway - reclaiming premiums paid to a loan thats done and dusted would be incredibly hard and I can't imagine they would be set up to attempt it. - could have had PPI and late payment fees (both reclaimable possibly depending on how the loan was 'dead'ed lol)
Mortgage - current mortgage at a guess - possibly a few late payment fees in reality.Last edited by Amethyst; 31st July 2009, 06:18:AM.

I certainly did not draw any comfort from that email, as t is if buts and maybe's and nothing concrete.
According to your earlier thread you had already paid a fee
'I guess my concern now is that I have given them the original fee and copies of all my paperwork etc so how much damage can they do?
And I thought they sounded legit! So what actual payment are they now asking for?
The response I received from Forbes was also flimsey as they have not actually responded fully to all my concerns. All I wanted was my questions anwered but like your response from Cento they have not given direct and clear answers.
I agree with your stance in asking for further clarification.
If at the end you are not happy with their response you can ask the MOJ to intervene on your behalf, as aparently Forbes told me that Cento have had a recent inspection from the MOJ and passed with flying colours as fit for business.

As they claim to 'act' in house in "some cases" can you ask them who signs the claim form in the event the 'in house' matter comes to court??......... also as they 'sometimes act' in house who are their professional negligence insurer
