  • Allay Claims strikes again

    Hi There

    I've been having difficulties with Allay Claims since 19/08/2019. I received an email out of the blue saying thanks for signing your online documents, we're investigating your PPI claim with a bank you had a mortgage with.

    The next email said please can you sign the attached documents because the letter of authority we have on file is invalid. Of course I didn't sign.

    A further 31 emails followed escalating from your claim was successful to we are going to take action.

    I did speak to them on the phone and said why would I claim through them? I wouldn't and they said I still had to pay them.

    Since then they have passed my personal details to Credit Resource Solutions and then AJJB Law. AJJB Law are threatening to issue a letter before Claim in line with County Court procedures.

    This is all over £53.17.

    I've also received a letter from HBOS confirming they don't have a letter of authority on their files from Allay Claims regarding the PPI claim. This was in respect of a credit card I had with them.

    I'm not sure where they got my details but before this I spoke to a different claims company about my financial history but never signed their paperwork. That's the only place I can think of that they could have gotten my details.

    Incidentally they are spelling my name incorrectly.

    I'd appreciate any advice you can give me.

      Allay have the same problems from what i am seeing, over and over again, they dont comply with the distance selling regulations and dont provide cancellation forms in the prescribed form. I did write a piece on this a while ago, ill see if i can find it

        Is HBOS the bank that Allay are saying they made a successful claims with?

        I would ignore anything you get from AJJB Law unless it's a letter of claim which has forms to fill out. If so follow the advice in post #25 here Allay claims Bullying or trying to. - LegalBeagles Forum

        It's very unlikely that they would actually issue a court claim for fifty quid.

          Are the regulators not taking any interest in the lack of distance selling info? This is a massive breach of consumer rights law, and there should be enforcement action taken, especially after that Court ruling which confirmed the fact that they had not complied with the distance selling regs

              I can only shout so loud mate!

              I've given them the evidence of a deceased man who somehow signed up with them and I've also handed them a whistleblower (ex employee who is willing to spill the beans) on a plate.

              Allay Claims Ltd transferred the consumer 'debts' to Allay (UK) Ltd a couple of months ago but both companies are late filing their accounts so it may be they're not long for this world.

                    Hiya, AJJB Law have said I've missed the deadline for responding to a letter before claim and has said they can now issue a county court judgement against me. It's for £53.17. Am I better off just paying it and if I do will this mean they can follow on with other charges?

                      I'm unclear as to whether you received a letter of claim (as opposed to just the threat of one) and if you did, if you responded to it.

                      A letter of claim would have included forms to fill out, so did you get one and if so did you respond to it?

                      Either way they are extremely unlikely to issue a court claim for 50 odd quid.

                        Sorry for being ambiguous, AJJB Law say they are now in a position to issue a CCJ. I've received the following emails:

                        Pending Legal Action on 5th September
                        Preparing to issue a Letter Before Claim on 17th September
                        Final of reminder to take legal action on 21st October
                        Pre Litigation discount offer without prejudice on 23rd December
                        Letter saying I haven't responded to a Letter Before Claim and the time limit of 14 days has expired on 15th January

                        I don't know if I've received something in the post from AJJB Law. My name is spelt incorrectly on any letters from them and I tend to ignore them.

                          Ok thanks.

                          A letter of claim would have been sent in the post. But others who have not received one, or who have received one and responded have still got emails saying that they haven't responded like the one you've just had. AJJB Law are just a debt collection outfit staffed by low paid paid desk jockeys who just send out mass threatening emails regardless of what they've sent out previously.

                          As I said it's very unlikely that they'd issue a claim for such a small amount as it's just not commercially viable. It's up to you if you'd rather just pay to get them out your hair. You could just offer them £25. If they did issue a claim and you defended you would probably win.

                          By the way, you said in your first post that Allay first emailed you on 19/08/2019. When did they day that you signed up with them?

                            Thanks for the information.

                            The email I received on 19th September 2019, which was the first communication from them, said thanks for signing your online documents, which of course I didn't.

                            Then I received four emails saying we are unable to complete your PPI claim as the documents we hold are invalid.

                            I don't know where they got my details from, but they could have bought them from another company which I did give my details to but didn't sign the paperwork.

                              Ok. Allay used 'free PPI check' online forms to sign people up via ads on Facebook. But on 16 August 2019 the FCA banned them from using the free PPI check online form.

                              We know a lot of people who never filled out the forms or didn't even use Facebook and I've always suspected Allay got hold of people's data and filled out the forms themselves.
