  • Banksmart - Nightmare!

    Hi Legalbeagles - can you please help me. I am having major issues with Banksmart and seems I'm not the only one. I've been overwhelmed with the amount of breach of contract invoices I've received, now totalling £17,100.00 and probably rising all of the time. They have also put me to a credit company, CMS who state I need to pay this amount ASAP.
    So to address the issue I sent this complaint which will also outline my situation and some of what has gone on.

    Please accept this email as a formal complaint.
    I have been sent an incredibly extensive statement from yourself to the amount of £17,100.

    Let me please bring to your attention:

    I had explained to you that there were no claims on many of the accounts you are now charging a breach of contract, yet you have continued to pursue and charge me an account on this. I asked what was required to stop these statements and I was advised to fill in paperwork which I returned, but yet you have continued regardless.

    I discussed this again with you recently and was informed to fill in the new paperwork, once received I could see this was more agreements to continue to search, not for the closure as first intimated by yourself. I instructed I did not want to search these companies some time ago and more recently again I had given the same instruction, but now for some reason you are continuing this search and charging me for breach of contract.

    I have contacted the Legal Ombudsman and have taken legal advice and you will be hearing from me in due course. In the interim:
    • Send a full breakdown of what you have actually provided as a service.
    • Send me your full terms and conditions.
    • Any documentation with my signature.
    You have acted outside of any direction from myself and have no legal capacity to do so. I notice that you have issued close to £1,000 in charges in one month. These charges should be frozen.


    I have since received a response to my complaint which I would be more than happy to share with you.

    £17,100 ??? Cripes - what the hell do they think they are doing ?

    Firstly, they are only "allowed" to charge £400 maximum cancellation fee - which would be 42 claims!

    Do you have a copy of one of these forms they asked you to complete and return ?

    Have they split lenders into more than one claim ? ( unfair charges & ppi ? )

    Did they send you individual letters of auth to sign for each of the claims ? Did they send a request for you to allow them access to your credit file last year ?
