  • Bank-smart rip off

Hi I went with Banksmart to recover my ppiin 2007,they said they were experts in finance, the terms of agreement were 8% if they won on a no win no fee deal, when sent the documents to sign the terms and conditions had gone up to 27%. They never asked if I had been bankrupt or any like that, unfortunately I had been bankrupt 2years before that,as EXPERTS I thought they would ask that as they would no I wouldn’t receive anything, anyway they won £300 from a bank but didn’t receive anything nor did I as it went to the official receiver, they have been harassing me for over 11 years asking for £143 I have had numerous debt collectors sending me letters with threats of court but I have ignored and never had a letter to go to court, I have had another threat today and was wondering is there a way to stop all this please? There relentless and I have never received anything so refuse to pay these parasites, am I legally right or should I pay? Regards Dean

    11 years ?

Have you written to them, paid them anything etc regarding the 'commission' for the £300 refund in that time ?

IS the £143 what they are claiming from you now?

If not you can tell the latest debt collectors, WIlson Rose?, and BS, that the debt is statute barred as it is over 6 years since payment or acknowledgement. ( Limitations Act 1980 section 5 )

Okay 12 months ago is fine - what you want is a clear 6 year period where you didn't acknowledge the 'debt' - so if you didn't communicate with them at all between say 2009 and 2015 - it would be statute barred.
