Might the answer to that question depend on how much room was taken up by the celestial band stand?The strength of these rules is they are general principles – unlike the rigid UTCCR or CCA – so there is less scope for expensive lawyers to argue how many angels can dance on the head of a pin.

FSA Rules v 'core term' (surely the banks wouldn't try to trot out the 'reasonable charge for service' argument?)

I reckon a word of caution is in order. The last attempt Mike Dailly had at a bank charges 'test case' was an expensive failure and the case now languishes in the 'where are they now' file.
