Well, they didn't file an acknowledgement leastways an amended defence.

Consequently I filed for a Default Judgement.

Let's see what happens now?

Considering it's lodged in the High Court, a default judgement, whilst good news, unfortunately wouldn't be enough to set a precedent.

However, they still have 14 days after the Default Judgement has been given to apply for a set-aside, and if so also to provide an amended defence. If they don't then game over for them in this claim.

Going OK

Successfully defended 2 strike outs and have a full hearing date in Septemeber.

Currently hunting for the Supreme Court transcripts....any help?

Yup annoyingly however at least I have another defence

All 3 are different and contradict each other in their leading statements of fact.... Unbelievable and delightful at the same time 8)
