Hi newbee here anyone else had a very bad exprerience wih these payday loan companies and breakages of OFT guidelines I have had a frighteneing experence with Wonga who "RAPED" my bank account took out the money I owed them the proceeded to tell me I still owed them 197.00 (worked out I only owed the around £3.97) they now have added interest after 4 weeks of arguing recon I now owe over 400.00 they refuse to put account on hold to sop them going into my acount I changed this to a new account was sent vile E mails saying if I tried to do a charge back I could be committing fraud and jailed upto 10 years, and If I didnt pAY THEN THEY COULD SEND A FIELD AGENT TO ASSESS MY ASSETS PRIOR TO LEGAL ACTION. When I complained about this I received a voicemail from head of complaints saying he wished to discuss the breakages I called and this was another ploy to try and bully me into a payment plan. I again and again told him that the guidelines have been broken and that I wanted to persue this but agin refused to listen and when confronted about the banning of the advert and advised him of this told me that it ran its course I started to tell him about the ASA and what they had said for him to say not talking to you anymore and hung up. I have gone to all the usual agencies OFT ETC who seem to be very unhelpful and only very limited coverage by the media who just wanted to know about the APR's where can I go from here .

You need to issue them a subject access request and find out exactly how much they think they have paid you vs how much you have paid them. Ensure it matches with what your bank statements say. Id also issue a CCA 77/78/79 request just for good measure. If things come back and look wrong, then dispute the account.
Its not unheard of for payday loan companies to take payment, then 'forget' that they did and take it all over again, then argue with you about the whole thing - some say its a scam, others say its just sometimes mistakes get made.

already checked bank accounts and from thier and my cals I only owe 3.97 and when I asked to put into dispute they refuse. I thinking to go for letter before action over 42 E mails have swithed between us the ironic thing is I never entered in a repayment plan with them at all now sending me mails saying I defaulted on a repayment scheme (laughable)sigpic

Ok, do not under any circumstances give them the details of your new account.
Also do not call them on the 'phone. They could tell you the sky was pink with yellow spots and you have no proof.
Keep all of those e-mails safe.
Get together a list of the origional amount that you owed and how many payments you have made and for what amount.
Ignore threats of field agents etc - just tactics to get you to pay when you already have.

ive read this thread on cag and the way you have been treated is nothing short of discusting this is like ping pong and i feel having read your thread OTR the way to end it is start court action i think you need to see a solicitor as a letter from them maybe enoughIf you think nobody cares if you're alive, try missing a couple of payments.

They are not getting anything at all Im even saving day by day the amount of interest being chucked onto the account 5.00 per day added not phoned at all scince that guy left me that message about the OFT breakages then proceeded to lie to me Just wish the governing bodies could do something about them They all seem pretty useless OFT FSA etc jsut brush under the carpet jobbie. Even went to CAB about the offencive E mails only to be told or referred to Debt councelling DOH I have also as said been in the media about this and they as I said only interested in the apr charges and not breakages of OFT guidelines.sigpic

You have followed their complaints procedure and have got nowhere. Have you considered the financial ombudsman rather than waiting for Wonga to take court action against you.
You have evidence of amounts paid and the emails between you and the company trying to sort it out.
Definately send off the Subject Access Request and the CCA request, but I;d get a complaint filed with the Ombudsman first if the company are refusing to even look at the case.
Also - I'd pay the £3.97 so from your side of things its done and dusted (and keep evidence of that payment).
I presume you have made sure they cannot access your bank account again ?
IF you can a list of the payments made and advances taken in date order would be helpful, and if you have a copy of the agreement between yourselves it would also help. You'll need to do that for the FOS complaint anyway.#staysafestayhome

they cant get near my account the card on that particular acct has been changed and emptied out so if they tried they would get a short sharp shock. a new bank account has been opened so nothing cant be touched there they dont even know what bank it is as for the 3 quid of Im paying that end monthsigpic

My heart went out to you reading about your experiences with Wonga.
They were one of the last of my creditors to accept my DMP and the only way I got anywhere was to email every address I had for them every day until I think they got tired of dealing with me.
They have agreed to freeze interest and charges too.
But my experience is nowhere close to yours. I can't believe the way you've been treated. I hope everyone here can help you get some sort of solution.

Wonga went into adminstration due to recognised failings and defunct you have this recognised link to claim you should have received email if your loans were flagged up .. in admin there is no money in pot for goodwill etc but try the official link
