    Did you send the income and expenditure sheet to lloyds?

      i think did - but to be honest it was long time ago cant remember

      the response was that they sending the letter to Bristol and I should get an answer in few days, during that time I shoould read the voicing your concerns document. nothing came back regarding the complaint since, but i did receive letters regarding missed payements and that I have to pay unless I want them to send my case to debt collection agencies.

      I really had enough of them

        Do you currently have arrears on priority creditors, ie rent/mortgage, council tax, utilities?

        And they should have properly responded to you at the time. The DCA threats we will leave that to one side for the time being....

          yes I do now as I am out of work havnt paid my rent in 2months and nothing towards utilities.

          does this letter counts as the necessary response within 14 days or because they have not responded since, is it breaching the agreement?

          the only other letter they sent was an information about that they are covered by FSCS and in case they found to be "guilty" I can be entitled to claim up to £85k. but the rest is really payment request

            What you need to do is to cancel all non essential payments from your account. You need to write to the bank again, explaining how the charges you are receiving on your account are impacting on your ability to pay your bills and feed yourself. Include evidence and if you are in arrears with the rent and utilities, what have you done to alleviate them?
            Have you claimed Housing Benefit or Local Housing Allowance(if you're a private tenant)?
            Have you looked into any of the hardship funds that energy companies have to help with bills?

            I should add that the bank have failed miserably to respond positively as they should do under the Lending Code.

              I have already canceled all my payements and sent letter to 2 creditors both of them came back saying they cant help..... - but that can wait

              so You recommend me to send another letter to Lloyds as a reminder and tell them they have not responded positively according to the lending code? or what kind of letter did you mean?

                Oh and 1 more thing.when Lloyds pressured me to take the loan which should clear my credit card and the overdraft charges I was suposed to pay one amount to cover both cards. 2months after the bank started sending me balance of my credit card saying I still have to pay £5 extra on my credit card;what I had to cut to make sure I wont use again, and what suposed to be paid by my loan I had to take. they keep sending me letters regarding the credit card as well.

                Is this procedure right?

                  Loan aren't priority debts and credit cards aren't either. I don't believe the bank held a gun to your head to sign the loan so let's stick to the fact of breach of priority debts. Those two letters by the way are very very good evidence so please make sure you take a copy of each letter to send to the bank. Hang on one minute while I get you the breach of the lending code.

                  Section 9 starts by saying the above(link is on my signature so please read chapter 9.
                  You have helped yourself, ie you've contacted creditors for help. Are they charging you for non payment?
                  Have they made a real attempt to make contact either (a) by phone or (b) inviting you into the branch to discuss issues?

                    no attempt have been made by littlewoods they said they cannot help, HFC asked me to fill out a I&E sheet which i have to send back asap but yes they are charging me interest even so I have send the letter to them that at the moment I cannot keep up with the payements but agreed to pay 5£/month and asked them not to charge me interest as it will be impossible to pay things off.

                      HFC are not priority debts nor are littlewoods.

                      Priority debt are defined in this link.

                      See above. The letters if they are from HFC and Littlewoods offer nothing for financial hardship. Priority debts are ones that non payment can lead to loss of home and/or liberty.

                        as I dont have a mortgage dont have priority debts and I live with my boyfriend and his parents so we agreed I will pay soon as I get job as I helped them out last year quiet a lot.

                        I just want to deal with the rest of the debts as they are getting bigger and bigger mainly lloyds.

                        I know is not much but I want to deal with all my debts before they get out of order (excluding Lloyds and student loan all together £ 2500)

                              Hi Erica,

                              Leclerc is giving excellent advice here. Your circumstances have changed dramatically since you first posted and that needs to be taken into account now. The reason Di asks about ppi is if you have been made redundant it could help pay towards the debt, or if mis-sold, you could reclaim it to offset against the debt.

                                That is correct Casper, so for instance being make redundant they should pay out, so check your policy to see if there is any PPI, if so make a claim, if they don't pay out for some reason then make a reclaim on all the ppi you have paid into the account.
