We have a claim to yorkshire bank for £6147 plus interest with regards to bank charges.We have been made an offer of £2400 last week, under the grounds of financial hardship, however we have arrears on mortgage of £6198, this offer is not enough, WFTC and CTC paid into this account for the past 6 years, read the success win in Torquay, We have just recieved Questions allocations from court, which will cost another £100, our court is blanket staying until 28/02/08 because of test case, can we apply for the stay to be lifted with regards to the social security act, where can we find the template, anyone please !!

We will sort out draft directions for your allocation questionnaire to include the hardship aspect of your case and try and avoid a stay.

Which court are you at ? (please dont say cardiff! lol)

You CAN apply to have the stay lifted - we tend to work on personal applications rather than templates although we are going to put a guide up in the library today to assist people get started.

If you can PM me with full details of your benefits (how much u get a month etc) salary/oher income....also details of your mortgage arrear and any action threatened against you, and other debts.

We havent seen many lifted with other income included within the accounts, but the mortgage arrears might help with the judge - the SSA and Tax credits act are worth using.

We can't promise anything but we will help you give it a damn good shot.

it certainly looks like you may have a case to overturn a stay.
personal application's are deffinatly the way to go here (worked for me anyway )
just follow ame's instructions and let them work their magic..... there are no guarantees but ya never know, its always worth trying

Hi Deperate,,,
I have a very similar case to yours, my Abbey case hase been stayed, the court date would have been November, I too have Mortgage arrears not disimilar to yours and I also have income and benefits which Abbey tooks loads of charges against.

Ame, is helping me also, and I am sure she will help both of us overcome this horrible mess we have got ourselves into.
