  • Partial Success

    Hi, Firstly thanks very much to everyone for all the valuable information on this site that has helped me make a partly successful hardship claim against Halifax on behalf of a friend.

    I would however appreciate some help and advice on the following;

    My friend is recently divorced, is suffering severe hardship, IE two months in arrears on the mortgage (£960 ) in total £450 in arrears on loan/card payments and £200 in arrears in utility bills. I am helping to sort out everything but the advice I would like is that we claimed £1575 back from Halifax and they have accepted the hardship claim but only offered £511 as a goodwill gesture.

    Whilst obviously anything will help the situation, this seems a bit low given the circumstances? Is it worth refusing the offer and trying for more? Would they withdraw their offer if we do? Any thoughts would be most welcome.

    Thanks

    I would accept it and maybe ask for three months suspended charges and interest on top.

    Credit card charges(did I read that right.....reclaim central)
    Payment Protection Insurance on the loan

    Furthermore, a warm welcome to legal beagles site

      Hi Cobra and welcome to LB.

      Well done for getting as far as you have done.

      Can you tell us where your friend is up to with the arrears on the mortgage, in other words has she made an offer to repay the arrears and over what period of time, did she provide this information to Halifax as evidence of her hardship.

      I think if you could post up the letter which she sent to the Halifax, blocking out any personal details then we can see if there is any mileage in going back to the Halifax.

      Did she complete an income and expenses summary http://legalbeagles.info/forums/showthread.php?t=5102
      as maybe she has not included everything.

      Any information you can provide will allow us to help you further.

        Hi and welcome to Beagles.

        In addition to the above, if your friend is behind with credit card payments there are bound to be charges she can claim back on the cards. Can you let us know who the credit cards are with, as they are all fairly straightforward to reclaim from, but some are easier than others and its a bit more of a quick fix than bank charges reclaiming. She might not end up with actual cash in her pocket but any refunds will at least help to reduce the balance owing. Depending on how far the charges go back and how much the balance owing is there may be some money to be repaid to your friend.
