    RECENT SUCCESSFUL HARDSHIP CLAIMS
    Hopefully this brief outline of successful hardship cases will give potential claimants an idea of what constitutes hardship, and also show that if you persevere the banks will help you under the hardship criteria. ALL of these payments are INTERIM and the remainder of charges and interest will become payable on the successful conclusion of the test case. All these threads are on Legal Beagles in our Hardship Forum. There are also other successes I haven't yet reported here. I have tried to summarise the main issues and the outcome of each case.



    ABBEY
    65% of claim totaling £4400
    Claimant with Mortgage Arrears and suspended possession order
    Recent loss of employment and Ill health

    ABBEY
    65% of claim
    Claimant with Mortgage Arrears, more than £500 in charges and regularly exceeding overdraft.

    ABBEY

    65% of claim
    Claimant on low income, children and using 'payday' loans to survive day to day. Council tax on attachment of earnings.


    ABBEY
    65% of claim £2000
    Claimant had home reposessed and sole income Benefits. Loan taken to cover basic living expenses.

    HALIFAX
    Full amount claimed plus interest £5700
    Claimant with Mortgage Arrears, Council Tax Arrears, Utilities Arrears.
    Seasonal income self employed and Benefits.

    LLOYDS
    Full amount claimed
    Arrears with loans, council tax and hire purchase agreements.
    Income support, Carers Allowance, Child Tax Credits, Child Benefit

    LLOYDS
    £2200 (all charges imposed since loss of employment)
    DLA due to mental health issues. Claimant borrowed from Social fund in order to pay bank charges.

    FIRST DIRECT
    Full Mortgage Arrears paid direct (£3700) plus additional payment for bills and wiped debt owed to First Direct. (Total £5200)
    Arrears with Mortgage, Council Tax. Repossession order granted.
    Recent loss of employment

    HBOS
    Full amount claimed.(£2500)
    Ill health, rent arrears, council tax arrears. Income DLA and Income Support.

    BARCLAYS
    £8200
    Mortgage arrears and council tax arrears of 5k. Arrears in other debts. CCJs on Utilities arrears.
    Income Lone Parent Benefits.

    BARCLAYS
    75% of charges claimed.
    Claimant forced to give up employment to look after sick child. Arrears on debts, rent, council tax.

    LLOYDS
    Future charges cancelled, new repayment plan accepted on Loan.

    HSBC
    Claimant had arrears on mortgage and council tax. HSBC paid arrears to date directly - approx £2000.

    NATWEST
    £2300 paid.
    Council tax, rent & utilities arrears. Low income & Benefits.
    Recent relationship breakdown.
