  • asociablemisanthrope v Halifax

Hope someone can offer some advice. I initiated a claim to reclaim £3200 of Halifax charges recently using the initial Moneysavingexpert template letter, and the Halifax replied asking me to fill in a Common Financial Statement. Upon calling the CCCS for advice, I was told NOT to send the completed CFS (presumably something to do with the income / expenditure gap being so large) and not to disclose any financial details. Seems to be a bit of a chicken and egg situation as Halifax are unlikely to consider a claim without statistical evidence, though of course the account itself should prove that I fulfil at least some of the July 2008 FSA waiver criteria (including receipt of JSA). Do I now send a letter highlighting how I meet these criteria or do I ignore CCCS and send the completed CFS? I don't fancy doing the latter but if it achieves results...

    Re: Halifax and Hardship

In what respect did CCCS have concerns over the gap between your income and expenditure ? You are right, it is unlikely you will get your claim dealt with without submitting a CFS, a letter outlining your situation will help, but would likely have to cover most details you would put on a CFS anyway.

Which other criteria do you feel you meet alongside being in receipt of JSA ?

I would have thought it would have been in your interest to complete the income and expenditure summary. I know we have a good one on this site, I will try and find the link for you. As without this how can Halifax assess your claim. You would also need to advise the Halifax the reasons why you fall under the genuine hardship rules under the FSA waiver guidlines and you would need to send in all documentary evidences to prove your case together with an up to date spreadies of charges and compensatory interest.

I have no idea why the CCS have tabooed this - maybe the person you spoke to did not understand fully what you were trying to achieve or there is another reason that you and I are not aware.
