    Ok, regarding my illness i have just written a letter to the mental health team as its been 2 years that i have been left without support.

    Is there somewhere on this forum where i can start a new thread and ask for advice about my situation regarding the housing issue and if i can actually sue for negligence? or is this the wrong place to do this?

    I so want this over so that i can begin to sort my life out.

          Im still waiting. I recieved a letter 3 days after sending mine. they sent back my documents and confirmed that they had recieved my mail.
          That was over 2 weeks ago and i havent heard a thing since.
          Im not sure what to do now. should i send another letter or phone them?

          update on my other situation.

          I contacted my old mental health team but they wont help me until i see a gp. this is something i havent ever done as i just cant do it. they just dont understand that i cant keep meeting all these new people because of my illness.

          hey ho! i just have to except that i have to stay here and rot until its time to give up.

            Hi again

            there is a post on here by EXC ( you can do a search or I think it is in hardship section0 which explains the timetable the banks should be adhering to.


            Reference your other comment - that seems unbelievable! I dont have much experience in this area but my sister has suffered form serious depression and I have a work colleague whos husband suffers from Agrophobia and even through that I can understand how you are reluctant to see your GP.Surely they are supposed to be experts they should know that!

            Would it help if you had someone who could go with you - in that respect did you see if Mind had a branch near you ? You need some sort of local support when you have made that first step maybe you can start to look forward.

                Hey ALL,

                iTS BEEN A FEW WEEKS NOW AND I STILL HAVENT HEARD FROM THE HALIFAX REGARDING NY HARDSHIP CASE SINCE THEY RECEIVED MY DOCUMENTS.
                IN THE LAST FEW WEEKS THEY HAVE ADDED MORE CHARGES TOTALING MORE THAN £400 AND IM STILL OVERDRAWN BECAUSE OF THIS , SO MORE CHARGES.
                i THOUGHT THEY WOULD PUT THESE ON HOLD BUT THEY HAVENT.

                IM REALLY WORRIED NOW AS THE HALIFAX IS ABOUT TO BE TAKEN OVER MY LLOYDS. WILL THIS EFFECT MY CASE?

                i HAVE READ EXC'S POST AND HE SAYS THEY HAVE 8 WEEKS TO REPLY BUT I SHOULD PHONE THEM.

                PLEASE CAN SOMEONE TELL ME WHAT I SHOULD DO NOW.

                  Yep they do have 8 weeks but it cant hurt to give them a call and find out where your case is up to, also ask them to remove the £400 charges they have just added.

                  Have you looked properly at your account and why you are getting the charges still ? It would be better to cancel DD's etc and pay companies direct for a short time until you are straight

                    I have just got off the phoene to the halifax.

                    The women spoke to customer relations and she told me that they will be looking at my claim tomorrow.

                    As for the charges, she said they cannot give back the extra charges that i have had since my first letter.
                    I also told her that i had missed another DD on the 15th and asked if i would be getting another charge for this. She said yes, i will be carged another £35 on the 30th sept.
                    I asked if she could stop this but she said no.
                    her voice cracked a little when i told her i was recording the conversation.

                    so i think i'll wait another week then phone again.
                    should i send another letter regarding the extra charges and how im not happy.

                      I agree with post above - you need to regain control by having a basic account and then maybe paying your bills cheque or by phone when you have funds?

                      which DD are bouncing and do you have a list of priority payments you must make each month?


                      You are not guaranteed to get these charges back so is it possible for you to try and re-organise your account and DD so you can regain control. Then we can concentrate trying to get a refund.

                        I have done this.

                        i have a basic account where my DD are coming from and i have cacelled most but some need to come from this account.

                        half the charges including the one due to come out on the 30th are from this basic account.

                        i have just reread exc's thread and noticed that section 15 (a) of the FSA waiver states that the firm might waive future unauthorised overdraft charges.

                        cant i use this.

                        I have just listened to my recording and the women said that they will not add more charges but when i asked why they have been adding them on since they received my letter she changed the subject and ask if i wanted to cancel my DD'S.

                          Yes as far as In am aware that is what you should be aiming for. But the waiver agreement is a recommendation to banks - not all are playing ball.

                          Your next move would be letters to FOS and FSA.

                          If they effectively "freeze " charges and interest you still have to somehow pay your bills in order of priority.

                          I understnd what you are saying it is a vicious circle you dont have enough money because of the charges.

                          So do you in effect have an OD made up of charges - on an account where you dont have an OD facility. ?

                          is that right?

                          I am just wondering if you can get them to freeze this in affect - open a new account have a fresh start until they review your case. If you did not have the charges would you be able to meet current monthly outgoings ?

                            Hi all,

                            Good news.

                            I phoned them thursday just gone and they said that they will be looking at my claim on the friday.

                            saturday i got a letter offering me £2483, more than i actuallt asked for. they added on the charges since my letter.

                            it can be done.

                            thank you again for all your help. the money will come in very useful.
