  • County court money claim

    Hi,

    I have recieved a letter today regarding a debt from around 5/6 years ago maybe longer. I have been receiving a few letters from Robinson way regarding this in the past couple of years. But have just ignored them which was probably silly of me..now recieved this letter from who I think is Howard Cohen & Co Solicitors. Have a form now attached asking for earnings order requiring my employers details for them to pay the judgement. Obviously have read through a few posts but still a little confused of what I can do from now on in? This letter I recieved today 13/07/2016 was sent on 11/07/2016. It also says failure to respond to this letter within 8 days will result in my employer being contacted and I may also be sent to prison for up to 14 days!

    If someone could maybe give me abit of guidance on what my next steps I can take are I would really appreciate it.

    Hi Smurphy & welcome to LB.

    Some details of the cause of action would help.

    What is the alleged debt for (credit card, loan, o/d etc) & how much?

    As RW & HC are involved, I assume that the original creditor has sold it on; did you receive a Notice of Assignment?

      Credit card with Santander.. £3000

      Not totally sure what a notice of assignment is. This is all very worrying as this letter I have recieved today has said they will contact my employer.

      I have recieved a few letters within the last couple of years asking for earnings etc but just ignored.

        Any chance of you posting up a copy of that letter? (personal details obscured- don't delete them permanently as you may need the original in good condition)

            If you use "Photobucket" upload it to there and use the link, I find that the easiest way... However if you don't I believe it is [MENTION=49370]Kati[/MENTION] who can help... Apologies if im mistaken

                      Didn't you receive a court claim form & pack? (If no, can you think of any good reason why not?)

                          You have a court judgment against you and they are applying to enforce the judgment with an attachment of earnings via your employer. Have you had any court papers through in the past couple of years that you know of ?

                            I remember something to do with Northampton county court. But unfortunately was just ignored. So probably only got myself to blame for all this coming on top of me! 😐

                              It's not about blaming yourself it's about being pragmatic under the circumstances in which you now find yourself.

                              Do you have a copy of the CCJ? Was it a 'forthwith' order or was it an instalment order? I'm guessing the former not the latter if you never replied to the original summons. Please confirm and post up a copy of the CCJ if you have it.

                              Without seeing everything (the court history) a forthwith order may have the potential for you to apply to vary it. You may have missed the boat but give us a little more of the legal history in order for that to be considered as an option open to you.

                              Apart from acute embarrassment (I would be) would an Attachment of Earnings have a negative impact on your job? Some professions place a job at risk if there's a CCJ. At the moment your employer may not know about all this so negotiation with the Claimant (if possible) is something to think about.

                              Regardless of everything you must comply with that Court Order by 19th July.
