    Hello,

    I recieved a county court claim form in December from Arrow Global and the firm had their solicitors details on.

    The debt is from an old credit card that I had when I was 19 I'm 32 now from Sainsbury's bank and the debt is for, £700. I Sent back the form to the courts saying that the debt was statue barred and then received a letter from their solicitor to say they are no longer dealing with it and Arrow globals in house solicitor is now dealing with it.
    Arrow global then wrote to me said informed me around of 6-12 of February 2012 or their about's their exact words and that I made a payment in Feb 2010 to the account. They also told me the credit card was taken out in 2003.

    Firstly they couldn't have written to me as I moved from the address I lived the address I'm currently living at I only moved to in 2013 and in 2012 I was living in temporary accommodation, so I never received any letters or default notices or bank statement. Also I wasn't on the electoral role until last year so I'm at a lost to where they sent this letters.

    I have sent letters to requesting CPR 31.14 Request, but today I received s directions questionnaire (fast track and multi-track) form.

    if you could please let me know how to to complete this form and if I could get any other advice on that I should do next I would be hugely helpful as not 100% sure what I am doing.

      I think the court may have sent you the wrong form, could you give the court a call tomorrow please - there is no reason a straightfoward £700 debt claim with a statute barred defence should be allocated to the fast track. And that form is a bit of a pain compared to the small claims directions questionnaire form. If they did mean to send you that form then we'll have to fill it in asking it goes to small claims.

      Don't worry about the change of solicitors back to inhouse - seems to be happening a lot recently.

      You've sent a CPR 31.14 request - did you send a CCA with £1 for the agreement copy too ?

      Stat barred wise you sound like you are right and this Feb 2010 payment is an 'error' - the onus of proof is on them. We'll have to reply to their letter ( if poss can you scan a copy in pls - REDACT YOUR PERSONAL INFO ) - First job though call court and check they have sent you the right directions questionnaire and let us know.

        Okay thank you so much I will call the courts tomorrow and find out.

        I'm sending the CCA form as I just read this needs to be done as well yesterday. Will be doing that first thing and send that also by recorded delivery.

        I have looked at bank statement and I can't see a payment in Feb 2010.

              The letter shows a last payment date of 03/02/2011 ?

                Hello,

                Just to let you know I have tried calling the courts today and I cannot get through.

                The automated service said to call back another time or send an email with my query, which I have done and awaiting a response.

                Also I have sent request for the CCA form today by recorded delivery.

                With regards to the Notice of Proposed allocation to the fast track form it says I have until the 9 Feb to compete and send back.

                What should I do and should I complete the form ?

                  I read it wrong sorry. Yes they said the last payment was in 2011 which is still wrong as I've check bank statements and a payment for £25 never came out, plus I moved from the address from 2010 so I don't know where they would of sent the letters.

                    Excellent. Keep hold of those bank statements. Is that payment in 2011 a completely random date and amount or were there other £25 payments leading up to then ? (on your statements I mean)

                      Would that be a failed claim for payment by direct debit? Due to lack of funds perhaps?

                          I forgot to take a copy of the defence that I sent back to the court as I was in a rush to send it back as I got scared but Arrow Global said the purchased the debit from another company in 2012 and I don't recall making any payments to any other debt collection agencies I have asked them to proved proof of this

                            In the month of Feb I cannot see an amount for £25 coming out my account. But I will look though other months to check as they gave me that date in Feb I only looked at the month of Feb to be honest

                              Good morning I have spoken to the courts today and they have confirmed that I have been sent the right form.

                              Was wondering now how I should fill out the form. any advice please
