  • Ccj letter scared!!!

    Hi,

    I have no clue what to do I just received a county court letter about an old debt from llyods bank overdraft it's so long ago I can't even recall any details. Sure it was from either 2003 or 2004. The total amount is 954.00 for an overdraft?? What do I do? Any advice would be amazing!!!

      Please if you can post a suitably redacted copy of the N1 claim form Of

      Type in verbatim the Particulars of the Claim.

      We need to know when the OD account was defaulted and or when the bank demanded the OD to be repaid in full. Your credit file would assist ( Noddle is a free service online)

      Have you acknowledged service of the claim? If not do so at Money Claim Online (MCOL) state intention to defend in full.

      When you have the data post here again and tag me [MENTION=55034]nemesis45[/MENTION]

        Hi,

        Thanks for all the replies, unfortunately I.panicked when I received the letter and sent of the acknowledgement as I had no clue what to do and didn't want to go to court. Is there anything I can.do now??
        This is what the letter said:
        Mortimer Clarke solicitors,
        monies due under current overdraft
        The claimants claim is for the balance outstanding under a bank account facility llyods tsb bank plc. It was a term of the bank account that any debit balance would be repayable by the defendant in full on demand. The defendant has failed to repay the amount due. The debt was assigned to the claimant. The claimant therfore claims 824.00.

          Hello Rebbeca,

          As long as the claim has been acknowledged that gives us time to sort
          out a defence.

          Please do the following.

          Send a request under to the provisions of Civil Procedure Rule 31.14 (CPR) use the template from
          the forum library. This is for documents mentioned in the particulars of the claim.

          Mortimer Clarke has been careful here it seems by not mentioning much in the POC.

          However I suggest requesting the Demand for Repayment and the Final Demand letters and the Notice of Assignment.

          This goes to MC by signed for post 7 days for MC to comply.

          We need to know when the Demands were sent, and the date the account was defaulted, check credit
          files online use Noddle it's Free.

                Hi,

                I looked at noodle and I can't find anything on there for the overdraft, account or ccj! It just lists my credit cards and they are all fine.

                    Hi Becz, Just to confirm, when you sent off the acknowledgment of service did you just tick the intend to defend in full box or did you write your arguments on the form ?

                      I stopped using the account in 2004 and the letters came about six.months ago from.Mortimer and Clarke.
                      I didn't write any arguments on the letter.I just sent it off saying I needed time to pay.

                          I don't have a clue I panicked, I have never dealt with anything like this and am about to emigrate next year so I guess I panicked.
