  • Rent errors ccj, without my knowledge please help.

Hello all am new on the forum been observing a lotlot on the sidelines. Have seen how active and proactive the forum is and I hope I will get the advice and direction I require. Well recently I did a credit check as wanted to check if we could get a mortgage. Low and behold found 2 ccj,s under my name and one for my wife.
    A brief history.
I met my wife when we still in university. Unfortunately when I met her she was also in debt and since we both had no role models. We normalised debt and would go on to take cars on credit or anything we could get. Until of course all the sources of finance dwindled. I am not proud at all with that period but consequently we left a trail of debt. Fast forward 2015. We are both professionals and we earn between us at least 60k a year. With the added advantage of extra work and agencies we could possibly earn more. Knowing that our credit status was deplorable. We had stopped applying for any credit over the last few years. We have actually managed to save about 15k since we began saving this year. During our period of debt going back From December 2014 we had lots of social, personal and emotional issues and at some stage we separated with my wife and kids and she ended up in a homeless shelter. I ended up living somewhere else.

Now in 2013 when I was living elsewhere I ended up racking about 1800 in rent errors. We then decided to move back together with my wife, for the good of the kids and us and quiet frankly it was the best decision I ever made. Now of course that was still the period when to us if we could get away with any debt we had to so I left the property and totally ignored the letting agents asking for their money.

Now sometime in 2014. I received a voicemail from the letting agents advising me that I should attend court and that summons were issued for me to attend or else I would be arrested. Never having been in front of a judge, was spooked, sent them an email and in that email we managed to resolve it all as I agreed to make a monthly payment standing order to clear the debt court action was then stopped and have never missed a payment. It's only this week as mentioned earlier when I found out that the same letting agent had actually got a ccj in 2013. I was surprised by this but then again back then as already mentioned I never really took responsibility about these. I then rang that court and found out that the ccj had actually been ordered or obtained from a previous address one that I had lived 2 times before I had moved to the letting agent that had applied for the ccj. When I began looking into this further. I then discovered that the judgement had been obtained on 2/4/13 and on 24/5/13 an email had been sent by the letting agent to advise me that they had obtained the ccj. So the letting agent had advised me of this after the ccj had been obtained and the ccj had also been sent to the wrong address based on the information on the credit file. The court also informed me that the ccj had been sent to my last known adress but was unsure what and where they had obtained the adress. The letting agent had my number and email as well as they had managed to contact me in 2014 when they wanted me sent to court to force me to pay the debt but obviously we settled it before court. This left me surprised as to how they never informed me via email as that was how we were communicating about the debt and only informed me based on the email I found after the ccj had been awarded to a much previous adress. Just for info I always updated my license details with dvla. I then emailed the letting agent yesterday as only found out this week about the ccj and via email they were not able to answer me some questions. I asked them how the debt could have been awarded without my knowledge and also at the wrong address. They only replied to state that if I felt that the debt was wrong I could appeal however it's not about the debt being wrong but it's about how the ccj was awarded. Have I got any grounds for a ccj set-aside based on this information.
