    Hi there,

    In 2008 I fell behind with the delinked loan element of an old Together Mortgage. They refused all offers of payment through DMP and defaulted the account, issued a CCJ and then secured a charging order. My issue is that on my credit file, the account shows as "Arrangement to Pay" rather than defaulted... if they had registered the default it would have fallen off my credit file by now, which is now beginning to look a bit tidier. I know that some companies do put AR markers on, but on the basis that it was defaulted (and I have the default notice) and it had to be defaulted in order for them to obtain a CCJ anyway, then surely they need to update my account to reflect this? I am about to write to them regarding this and just wanted to know what I should be saying in my letter to encourage them to deal with this in the manner that I'm requesting?

    How much approx was the unlinked loan for? (just wondering if you are caught up in the ''is it / isn't it'' regulated under the CCA issue that's currently in court )

    So they defaulted you, got a CCJ and a charging order - that will be on your credit file of course as a CCJ - and thus if that was in 2008 should have just about fallen off the file now.

    Yes the arrangement to pay should have been removed when you defaulted - it does sound as though it should never have been on an arrangement marker anyway as they had refused any arrangement through your DMP.

    I'm not really great at CRA file issues so hopefully someone else will be able to help you with the letter to NRAM to tell them to remove the AR maker.

      Many thanks for that Amethyst.... the loan was for over £25k, so yes the "is it or isn't CCA regulated" saga does apply to us, I think! That said, we have not received any correspondence to advise that we are "one of the ones"... I wonder if that has anything to do with the status of the account.... I haven't read up on the issue lately so I'm not quite sure what the current state of play is regarding these loans....

        The judgment was appealed, heard yesterday and will be handed down sometime between now and July.

        Transcripts of Monday/Tuesday's hearings should be up soon on the NRAM website (they've been ordered to publish them quickly by the court )

          Ok thanks, I still have no idea if we are "one of the affected" though. Although I do remember at the time of receiving this summons that I wanted to defend it on the basis that it was a loan "regulated under the CCA" but in fact couldn't possibly be, because that only applies to loans under £25k... at the time I received advice to the effect that it was rather a moot point and had no chance of going in my favour...
