                  Just means the case is now on hold, and the claimant will need to apply to court to pick it up again. Usually they try pick it up agian when they have found the documents.

                  You could apply to have it struck out but this will cost £155 and usually results in the claimant's being ordered to supply the documents/respond to the defence.

                      Carter has not filed documents with the court.
                      The claim is in suspended until Carter applies for the
                      stay to be lifted if the get the documents to support
                      the claim, or if this is drawn out then you can apply
                      for it to be struck out.

                        Hi, just received a notice of proposal of allocation to the small claims track from Lowell Portfolio, as far as i was told by the court the case is stayed and i have not been told otherwise, Any ideas of what I should do?
                        I have had no response from Lowell nor Bryan Carter to the request of documents. Should i not responde to this Notice?

                        Any help would be welcome!

                              Ok small claims track but without compliance with the CCA request it's unenforceable.

                              Check with the court again tomorrow.
