Hi there, I wonder if any of you can help me on this please. My wife took a Halifax credit card out on 12-06-2007. She fell behind with payments along the way and went to a debt management company late in 2010 to help her. He had been managing her accounts until recently when he retired. We are trying to sort our own affairs out now. I have sent a s78 request to Halifax/PRA Group and received the reply which is attached. Her credit file says the agreement started 18/06/2007-the response from Halifax with the supposed copy of the credit agreement says 12/06/2007-don't know why they should differ. Can anyone advise if this is a copy of the actual credit agreement ( or a copy of the application) and does it satisfy S78 request please? Thanks Mc

Yes that is a copy of the credit agreement. Looks like it is also the updated terms as well.
Only thing I can think is missing for compliance with a section 78 request is the statement of the account status which they usually put in the coveirng letter.#staysafestayhome

Thanks Amethyst-This is being handled by PRA Group now. I had send the S78 to PRA and they forwarded it to Halifax. Are PRA a part of Halifax or a separate entity? I am in a position to make them an offer on this but not sure how much-any suggestions? The total owed is £1587.87. This amount includes the rip off charges etc.
We have a joint mortgage with Halifax also but I don't know if there is any connection between that and the card section? By the way this site is fabulous-fantastic help on here. Mc

Portfolio Recovery Associates are a Debt Purchaser, not linked to or part of Halifax. PRA is very persistent.
If you are tempted to make a full and final payment offer it must be made on certain conditions:
1. The remaining balance is Not to be sold or assigned to any 3rd party.
2. Credit Reference files to be marked as settled. ( paying the debt off will not result in removal from credit files, this will happen on the 6th anniversary of the default date.)
3. If the offer is accepted payment will be made within 7 days from the date you receive the creditor written acceptance.
4. The offer is made as a gesture of good will and without admission of any liability.
Start with an offer between 10-15% of the balance, to give room for negotiation.
DO NOT send any payment without the written acceptance any such payment can be applied to the account leaving the balance open to more collection activity.
