  • Set Aside hearing

    Please could someone advise.
    We had some debt issues a few years back and have pretty much sorted it out.
    However we have been hounded by a company called AKTIV KAPITAL as ZUG BANK they say they bought the debt from
    Varde Investments in 2010 - It says the original debt was from 2006 with MBNA
    We asked for proof of this debt as I could not work out what it was especially as over £5,000
    They sent their terms and conditions and 3 months of copy statements? Yes it has my name and address on but it say SKY card which I have never had....
    Following this to my amazement a county court judgement arrived and I had no idea this was happening...
    We took advice from another consumer site and asked the court to apply for the matter to be set aside.
    We have a hearing in 2 weeks and I am so stressed I just dont know what to say or expect.
    The chap who was advising us on the other site is on holiday until march so is there anyone that can help please?

        Hiya, Alright for some having a months holiday isn't it . Did you submit a draft defence with your set aside application do you know? It should all be quite straightforward if you didn't know the court claim had been entered and the judgment was in default. It sounds like you'll be okay with a defence based on the CCA if they have sent the complete wrong one.

        Could do with seeing a copy of your set aside app and if you had a thread elsewhere might be an idea to pop a link here so we can check what you've done to date on this, and save you retyping everything

        What date is the actual hearing and have you been ordered to submit documents/witness sttements etc in advance ?
