  • Business Debt?

    Hi, not sure if i am doing this right as its my first post (apart from the "saying Hello" post). I have what may be classed as a business debt and am being pursued by a company called Lombard Legal on behalf of the creditors. Lombard Legal have sent various letters saying there is a CCJ for this debt and have sent 2 "heavies" to my door who i believe are trying to pass themselves off as bailliffs. The letter from LL in layout and language looks very much like it is trying to convince me they are solicitors. They do not appear to be either solicitors or bailliffs and indeed there does not appear to be a CCJ in place that they claim to be acting to enforce! (although i am aware of the alleged debt it has not turned into a CCJ)
    This is the very short version of the story but i really could do with some help.
    If it is classed as a business debt does the Debt Collector have to be authorised by anyone or can it be just any old thug the creditor wishes to use? Been advised by CAB to write to creditor and LL and complain about their conduct.
    What would the advice be from you guys please?
    I appreciate you will prob need more info so if someone has time to look at this just let me know what you need.

    Lombard Legal is well known well establish " business" practice, with a wide coverage on business debts and asset recovery.
    Who are Lombard acting for?
    Have you checked that a creditor has Not obtained a judgement by default.
    If you could explain what the debt is please and post up a suitably redacted copy of their letter is would be of great help.

      Thanks for such a prompt response, sorry for my delay in replying. Couldn't get the blinking scanner to work! Checked with the court again this morning as i did after i was called upon by these "gentlemen". Court told me the same thing again The creditor did an online claim back in Nov 2013 (NOT 2012 as claimed in 2nd LL letter) it became "stayed" in Aug 2014 as nothing had happened with it.
      The creditor is a Financial Services Business that i had a brief relationship with and the alleged debt is for reclaimed commission on policies they say have been cancelled by the clients (there is MUCH more to this saga but hope that's sufficient to start with?)
      I have had 2 letters from LL in the post plus 2 handwritten ones on headed paper from the visits made to my address. I will attempt to scan the 2 received in the post to see what you think. Thanks.

        Sorry! This is so pathetic, i don't know how to put the 2 letters onto the site! Can anyone quickly tell me please? Am used to attaching docs in an email but can't see the paperclip thing on here?

                    Hi Upscreek,

                    This claw back of commissions paid, under what term was the commission paid was there a time scale in which the commission could be clawed back if a client cancelled?

                    I am aware of some " misinterpretations " causing" problems.

                    Have you check trust online the registry for all CCJ's (there is a small fee for each address checked) is may also be wise to check credit reference files for any such judgement.

                    Equifax and Experian have 30 days free trials, Noddle (Call Credit) is free.

                      As i said it's a longer story but IF they can prove i owe the commission it is reclaimable if the policies cancel within 48 months of inception as it was paid on an indemnity basis.
                      On 10th Oct i checked Reg Trust for both the addresses that they have and the CCJ LL refer to is not there. I checked Noddle at the time and a number of times since, the latest being this morning and it is also not there. This combined with the court saying that the claim is "stayed" makes me think LL are telling untruths either through incompetence on the Creditor or LL's part or because they think by saying these things i am more likely to pay up.
                      My current thoughts are to try and stop the harrassment by a good shot across their bows along the lines of intimidation, harrassment , false information, purporting to be bailliffs and anything else i/you can think of (all of these things they appear to be guilty of). At the moment i am trying to focus my response on their conduct (both the Creditor and LL) rather than the merits of the claim. Don't know if that makes sense or is a sensible course of action at lease to begin with?

                          Good morning Upscreak,,
                          These " claw Back" clauses are usually confusing an much biased in favour of the company.
                          Now you are sure that no CCJ is on file I would be thinking of making a formal complaint to the company (CEO, Director Level) laying out the alleged lies and misrepresentations made in pursuing the claim.

                              Tis often that the exec level directors have devolved so much of their responsibilities to lower levels and the staff concerned have little guidance or authority to do their jobs..
