I have been issued with a judgement from a summons I knew nothing about. My husband and I are separated and live at different addresses. The debt is his but they decided to chase me for his lack of payment. He filled out my claim form in his name which was obviously disregarded and seen as me not reponding. I have been judged and now have a huge debt of his in my name. My ex has now confessed and passed all the paperwork to me, but is it too late to explain to the court that I had never received it? I would be very grateful for any help as this worries me that there are other debts that he will lumber me with too.

It was a business debt of which we were both directors. My ex had already had a summons from them in his personal name with T/A the business name. It was sorted with a payment plan so no judgement for him. But he has not kept to the plan since May so even though the business was closed years ago and we have since separated, I have phoned their solicitor today who informed me that I am liable as I was a director. This may be something I cannot do anything about this I suspect, but I am really concerned that my legal post is being opened and withheld. :tinysmile_cry_t:

It was money that he was supposed to pay to this company on the sale of a car. I only consider it 'his debt' as I was a director in name only. He ran the business and I had no idea that he had created this debt at the time. Only when the phone calls started to chase him did I realise what he had done. So legally it is mine too unfortunately whether I knew or not.
