    I signed as guarantor for my step daughter so she could rent a house. The initial AST was for 6 months. But the guarantor agreement said "this guarantee shall continue throughout the period that the premises are occupied by the tenants and is not limited to the term specified in the tenancy.." My daughter now has a 12 month agreement and had verbally been told that I was no longer required as guarantor by an employee of the letting agent. The Letting agents are now saying that I am still guarantor. I would appreciate advice on 1) whether such a term amounts to an unfair contract term in that it creates a very one sided agreement and 2) if it is a valid term and I am bound to it can I avoid being guarantor after this 12 month period? I expected to be guarantor for 6 months and even if not guarantor will assist our daughter now she is in difficulty. But I am concerned that I may have created an ongoing situation and wish to know the limits of my responsibilities. I expected the term to be used if a tenant refused to leave after the end of a tenancy period and not to apply to every new term my daughter signed.

    Hiya, Welcome to LB, It isn't something I know much about, hwoever there is a long thread regarding exactly this subject on landlordzone, from both the tenants, guarantors and landlords points of view which may be of assistance. It appears it is a very standard term in a guarantors agreement and it seems to only way to stop being guarantor is for your daughter to ask for a new tenancy agreement on her own terms - which is unlikely to occur if she has just started a period of financial instability.
