      We'll just had a letter through the post stating that restons are taking me to court on the 16th October via a telephone hearing.

      as you know I filed for the loan to be statue barred as I have not made any payment for the last 6 years.
      they have come saying my last payment was in 2010 via a PAC-agent payment? Plus there has been various payments of £50 with an entry of won-write on? Again I have no idea what these payment are and who has made them?

      they are also asking the court to

      lift the stay of proceedings
      strike out the defence or
      for summary judgment and
      for an order that the defendant do pay the claimants costs on a contractual (indemnity) basis pursuant to CPR 44.5

      what are all these agent payments and can they legally pay money towards my loan just to show payments have been made?

      would really appreciate any help with this as I can sense it is starting to go over my head and with a court date set I am starting to get a little anxious!

        Would you think it would be best for me to get a solicitor at this point or is this still something I can sort out my self?
        i do feel this is starting to go over my head a little.

        Also so after all this time would they have not applied for a CCJ against me by now?

        would really appreciate any feedback,I know your all really busy on here but just don't want to run out of time with the court date set.

            can you ask for clarification on these?? Surely there will be a record of how/where/when these payments were made somewhere ....

              My last payment was on the 07/2007 since then there had been payments made up until 2010 with these wordings before the payment
              cdad miscellaneous debit
              Pac agent payment
              PP payment
              Woab bad debit write off
              uddc payment
              Won write on payment
              Pacx agent recall
              Woff write off

              I have no idea what these payments are and how legitimate these are?

                They sound like internal management of the debt rather than anything that would be construed as a payment or acknowledgement by you. it isn't a secured loan or anything is it? So should be stat barred. I'll see if I can suss out what those transactions might be.

                    Hmm can't find anything other than the woab write off, it sounds to me that it went out to a couple of debt collectors and came back again, the only worrying bit could be the won write on payment bit .... could always try a sar to northern rock although possibly a bit late time wise.

                          Have I posted this in the wrong section as it doesn't seem to have many replies?
                          Would really appreciate a little guidance on this but also understand you all have jobs and busy lives.
                          Does anyone know of a good solicitor that would deal with something like this?

                            Could you have paid a Debt Collection Agency, or maybe had a Debt Management Plan, that's made payments to the loan?

                            Your defence is that the debt is statute barred.

                            I still think you are fine, we should write a Witness Statement though to go into court 14 days prior to the hearing.

                            This should say when your last payment as made (and if you have it include your bank statement showing that payment) and state that you have not made any payments to anyone else for this debt since then.

                            You should also try check your bank statements from the time they say these £50 payments were made.

                            Did you get a copy of the credit agreement?

                              Had you had PPI on the loan at all that paid out when you stopped paying ?

                              (just trying to work out what the PAC agent bits are about )

                                yes there was ppi in place on the loan.
                                They have sent me copy's of the credit agreement
                                I have got bank statements which state when I last paid monies to them.
