In theory they are supposed to send a letter before action prior to issuing proceedings. They are not usually headed that way, so are often mistaken for yet another threat. If you get a letter from solicitors talking about legal action, do post up here. :typing:

You can't really guess what will happen next because every account is different. If by BC you mean Brian Carter, then I'd say yes, they seem to be issuing proceedings non-stop and mostly without warning, some people get a letter saying they will issue a claim in 48 hours, others get it saying they have already issued a claim and the letter arrives on the same day as the claim. This is not in accordance with the pre-action conduct but they seem to get away with it.
Having said that, if they haven't issued proceedings in so many years...
You can often stave off court action by responding to letters and, should they go all the way, it would make you look much better if you had replied to their letters as opposed to ignoring them. :thumb:
