  • CCJ applied for not obtained

    My husband received letters from Lowell about 2 debts from over 6 years ago, I sent a letter re statue barred and their reply was that one had a CCJ attached and one a CCJ had been applied for but not obtained. Therefore neither were statute barred.
    I understand this re the one where a CCJ had been obtained although it doesn't show up on any of the credit reporting agencies. But where do we stand re the applied for but not obtained? Also with regards to the over 6 years one do we tell them they have to reapply to the court to enforce it or just ignore them til we (if ever) get a LBA. Mainly concerned about collectors turning up when my daughter is alone in the house.

    Sounds like they are claiming they started a court action within the 6 year period but for some reason it did not proceed to trial and so no judgement (CCJ) was issued. But that does not necessarily mean they can resurrect the claim now. More information needed. If no judgement was issued there's nothing for them to enforce.

      a) You could check on 'https://www.trustonline.org.uk', there is a small fee.

      b) If there is a CCJ, they would need a very good reason why they haven't acted previously to 'enforce' it,
      if they try, you can defend it.

      c) Sometimes there maybe an 'error', where Lowell's claims there's a CCJ, but in reality one doesn't exist,
      they need to provide details, you could check with the Courts.
