    Hi,
    I understand the concept of a debt being statute barred but i'm not sure if this changes should the original lender sell on the debt either before the 6 year period or just after the 6 years. In practice how can the new owner enforce payment of the debt once it has become statute barred ? Many Thanks

    Hi, the limitation period for most types of debts is 6 years from your last contact with the creditor or your last payment towards the debt. The debt becomes unenforceable after that period of time regardless of whether it has been sold or not. Also, the CCJ will not affect your credit rating after 6 years. However, if you have received a CCJ regarding the debt then the debt is still enforceable even after the limitation period (6 years).       Also worth mentioning that until the debtor sends a 'prove it/time barred' letter to the creditor, they can and will continue debt collection activity, including buying and selling of debts under The Law of Property Act.
